This is a situation many separated parents face every summer.
The holiday has been booked for months. The children are excited. The departure date is approaching.
Then the message arrives:
💬 "I'm not giving you the passport."

What many parents don't realise is that this isn't really a dispute about a passport.
It's a dispute about parental responsibility and whether one parent can stop a child from travelling.

📌 If both parents have parental responsibility, neither should use important documents such as a child's passport as leverage in a disagreement.

📌 If there is a Child Arrangements Order stating that the child lives with one parent, that parent may be able to take the child abroad for up to 28 days without needing the other parent's consent (depending on the circumstances).

📌 In other situations, consent from everyone with parental responsibility may still be required.
The biggest mistake parents make?
Waiting until a week before departure to deal with the issue.
By then, court applications can become urgent, stressful and expensive.
If you're travelling with your child this summer and there is tension between parents, check the legal position early—before the airport countdown begins.
✈️ Has your child's passport ever become a source of conflict after separation?

In England & Wales, unmarried couples do not have the same legal protections as married couples.

That's why proposed reforms to cohabitation rights are making headlines.
Supporters say the law hasn't kept up with modern relationships.

Critics say people should choose marriage if they want legal protections.
⚖️ Family law is now facing one of its biggest debates in years

💬 What do you think?

Should long-term cohabiting couples have the same financial rights as married couples?

❤️ YES 😮 NO

Reminder: A child should not br used as a messenger between adults, a weapon, nor a shield.

When parents separate, contact with both parents should happen when it is safe, healthy, and in the child’s best interests.

If a child is being emotionally harmed, manipulated, frightened, or exposed to abusive behaviour or adult conflict during contact or handovers, their voice matters.

A child is entitled to be heard.A child is entitled to feel safe.A child is entitled to have their wishes and feelings heard.

Family law is not about forcing contact at any cost, it is about protecting the welfare of the child and keeping their interests paramount at all times.

If contact is causing harm, legal advice from Raphael Law can help you understand your options and protect your child from harm.

This is your sign not to agree to anything until you understand your rights.

In England and Wales, informal agreements about divorce, finances, property, or child arrangements may not protect you in the way you think they do.

Before you agree to a financial settlement, move out of the family home, change arrangements for the children, or sign any paperwork, it’s important to get clear legal advice.

You may need to understand:
• Your rights in relation to the family home
• How pensions, savings, debts, and assets may be considered
• Whether a financial agreement should be made into a court order
• What is in the children’s best interests
• The long-term impact of any agreement you make

Family law decisions can affect your home, your finances, your children, and your future. Contact Raphael Law today help clarify your needs and entitlement

Clarity first. Agreement second.
