For couples who have built a life together over many years, it can come as a shock to discover that the law may still treat them very differently from married couples or civil partners.

Under the current law in England and Wales, there is no recognised status of “common-law spouse”. If an unmarried partner dies without a valid Will, the surviving partner has no automatic right to inherit, whether they have been together for two years or 30.

The Government’s consultation, A Fairer End to Relationships, is considering whether certain qualifying cohabitants should receive automatic inheritance rights where their partner dies without a valid Will.

If introduced, the reforms could give surviving partners a much stronger legal starting point. However, the proposals are not yet law, and they would not remove the need for careful estate planning.

For unmarried couples, having an up-to-date Will, appropriate property arrangements and, where suitable, a Cohabitation Agreement can provide far greater clarity and protection.

Having qualified in March 2007, Emma combines depth of knowledge with a personable approach. She holds a Bachelor of Arts in History and Anthropology and an Advanced Postgraduate Diploma in Law, both from Oxford Brookes University.

Key changes include frozen Inheritance Tax allowances, rising taxes on property income, dividends and savings, and a new levy on high-value residential property from 2028. Crucially, from 2027, pension pots will be included within estates for IHT purposes, altering long-standing assumptions about pension planning.
These changes mean that waiting could cost families more, sometimes considerably more, when the time comes to pass on assets.
