A new insurance scheme has been developed to enable people living in high-rise buildings to sell their homes in the wake of the Grenfell Tower fire tragedy.

Following the fire in 2017, mortgage lenders became reluctant to lend to buyers of flats in high-rise buildings, and sales dropped rapidly.

An aviation firm must pay £8 million due under an aircraft lease agreement after failing to provide a good reason to have a court order set aside, or for delaying legal proceedings.

The director of DAC was also the director of a Canadian company, which had provided a corporate guarantee to AMRA that DAC’s payment and performance obligations would be met.

The director also provided a personal guarantee.

Two aircraft were returned to AMRA between 2017 and 2019 but DAC had failed to pay rent and failed to keep them in good repair and condition.

Care Home granted injunction in £2.59 million contract dispute

A care home group has successfully applied to continue a freezing against one of its building contractors. The case involved Nicholas James Care Homes and Liberty Homes, whose business relationship had begun in 2002.

In March 2020, Nicholas James believed that it had overpaid by around £1.5 million for the development of a care home. Liberty disagreed and stopped working on the project in July 2020. It sent a pre-action letter of claim for £1.15 million that it felt it was owed for several projects. Nicholas James responded by asserting an entitlement to recover overpayments of £2.64 million.

TV’s Kate Garraway highlights value of powers of attorney

The heartbreaking experience of TV presenter Kate Garraway and her husband highlights the value of drawing up (LPA) to protect your future.

Garraway’s husband Derek Draper suffered a terrible reaction to Covid and still has a long way to go in his recovery.

The Good Morning Britain star said that the two of them had discussed assigning one another power of attorney before the pandemic started.

Sadly, they didn’t get around to doing so before Derek fell ill.
It made the terrible situation even more distressing as Garraway was unable to access their joint savings, or Derek’s bank or credit card accounts or refinance their mortgage.

No-fault evictions are to be banned as part of government plans to “end the injustice of unfit homes and help protect renters from the rising cost of living”.

The Fairer Private Rented Sector White Paper is designed to ensure millions of families benefit from living in decent, well looked-after homes as part of the biggest shake up of the private rented sector in 30 years.

The White Paper says most tenants enjoy safe and secure rentals, but for the 21% of private renter households who currently live in unfit homes, this ‘New Deal’ will extend the Decent Homes Standard to the private sector.

This means homes must be free from serious health and safety hazards, and landlords must keep homes in a good state of repair, so renters have clean, appropriate and usable facilities.
