Immigration compliance is no longer simply an HR responsibility. Increasing regulatory scrutiny, evolving sponsor licence obligations and stricter enforcement activity mean that businesses must now view immigration compliance as a core governance and risk management issue.

Lisa Uttley, Partner and Head of Immigration at Gherson Solicitors LLP, was featured in New Business magazine with an article exploring the growing compliance challenges facing UK employers and outlining practical steps organisations can take to strengthen their immigration governance.

The article, "Beyond the Visa: Navigating Risk Management in Immigration Compliance", was first published by New Business magazine: https://www.newbusiness.co.uk/

A practical demonstration of how the Statutory Residence Test is applied: Michael Parker v HMRC [2026] UKFTT 652 (TC)

The tribunal has confirmed that, in some circumstances, days spent in the UK between international flights may qualify as transit days and may not count towards an individualsโ€™ UK day count under the Statutory Residence Test (SRT).

The tribunal has also confirmed that days spent in the UK due to disruption caused by severe weather may be excluded under the SRTโ€™s exceptional circumstances provisions.

Learn how the Statutory Residence Test applies in practice, as the Parker case clarifies UK tax residence, transit days, exceptional circumstances and HMRC scrutiny. >> https://www.gherson.com/blog/statutory-residence-test-do-transit-days-count-for-uk-tax-residence/

Thomas Cattee, Partner and Head of White Collar Crime at Gherson Solicitors LLP, has published an opinion piece in GRIP titled โ€œWhy the UKโ€™s stablecoin pivot is an example of regulatory credibilityโ€.

In the article, Thomas discusses whether the UK can deliver โ€œthe one thing global financial markets value most: regulatory certaintyโ€. He explores the Bank of Englandโ€™s recent softer approach to aspects of its proposed framework for sterling stablecoins and explains why this may represent more than simply a response to industry pressure. According to Thomas, โ€œthe bigger story is not about crypto lobbying or regulatory retreat. It encompasses something more fundamental: the future credibility of UK financial regulationโ€.

The article also discusses the evolving approach of UK regulators towards digital assets, governance and compliance expectations. Thomas notes that โ€œthe next phase of UK crypto regulation will not be defined by whether firms are allowed to participate. It will be defined by whether they can demonstrate that their controls, governance, and risk culture deserve a place in a regulated marketโ€.

Did you know that some internationally mobile professionals can switch to a Skilled Worker visa without ever leaving the country?

However, itโ€™s not a one-size-fits-all process.

Crucially, those holding short-term visas MUST apply from abroad as Morgan Lim and our immigration partner Lisa Uttley discuss in our latest video
