OVERSTAYED in the UK but have a BRITISH CHILD? Your case may not be over. 🇬🇧

The UK Supreme Court decision in ZH (Tanzania) v Secretary of State for the Home Department [2011] UKSC 4 remains highly important in cases involving children and Article 8 family life.

The key principle is this:

A child’s best interests must be treated as a primary consideration.

If your child is British, that citizenship is an important factor. But having a British child does not automatically give a parent the right to remain in the UK.

The Home Office may look at:

• Whether you have a genuine and subsisting parental relationship
• Your child’s British citizenship
• How long your child has lived in the UK
• School, health and family connections
• Emotional and psychological impact of separation
• Whether it is reasonable for the child to leave the UK
• Your immigration history
• The strength of your supporting evidence

An overstayer should not assume that the case is hopeless.

Equally, a British child should never be treated as an automatic guarantee of success.

Every case depends on its own facts, the applicable law, the evidence and how the case is presented.

Has UK ILR changed from 5 years to 10 years?

There is a lot of misinformation online saying the five-year route to Indefinite Leave to Remain has already been abolished.

That is not what the Immigration Rules say today.

The Government has proposed a new Earned Settlement system, where the standard qualifying period for many migrants may move from five years to ten years.

But a proposal is not the same as a rule already in force.

If you are on the Skilled Worker route, the five-year settlement route may still apply, provided you meet all the requirements. The five-year partner route also still exists for eligible applicants.

Do not cancel your ILR plans because of social media rumours.

But equally, do not ignore possible future changes. If new settlement rules are introduced, the transitional arrangements will be extremely important.

Before applying, check:

your exact visa route
your qualifying period
your absences
your continuous residence
your current leave
your Life in the UK Test
your English language requirement
any suitability or refusal issues

A wrong assumption can cost you time, money and immigration security.

No visa sticker in your passport? Do not panic.

The UK immigration system is moving to digital status through eVisa. If your visa has been approved but your passport has no vignette sticker, you must check your UKVI account before travelling.
