A break clause can provide valuable flexibility in a commercial lease, but having the right to break the lease does not automatically mean that the break will be effective.

The wording of the clause, notice period, timing and any conditions attached to the break can all determine whether the right has been validly exercised.

Even a seemingly minor failure to comply with the lease requirements can create significant consequences.

If you are considering exercising a break clause, legal advice should be obtained before serving notice.

UK property law is entering a significant period of change, and landlords need to understand how the new rules affect their rights and responsibilities.

From the end of Section 21 notices to the move towards assured periodic tenancies and new requirements for rent increases, the changes introduced from 2026 will have a direct impact on how landlords manage residential properties.

Getting the procedure wrong can result in delays, disputes and additional legal costs.

For landlords, understanding the new requirements before taking action is essential.

Possession is not simply about serving notice and asking a tenant to leave. The correct procedure, notice requirements and timing can all affect whether a landlord can lawfully recover the property.

A procedural mistake can lead to delays, additional costs and unnecessary legal complications.

For landlords, getting the process right from the start matters.

A title register is an important part of a property transaction, but it is not the complete legal picture.

Ownership details alone do not tell you whether the property is affected by restrictive covenants, easements, restrictions or other rights that could impact its use, access or future transactions.

A proper legal review looks beyond the name on the register to identify issues that may affect the property before they become costly problems.

From May 2026, private landlords can no longer use Section 21 to recover possession of a property without relying on a legal ground. The Renters’ Rights Act 2025 abolished Section 21 “no fault” evictions in England.

What replaces it?

Landlords must now use the Section 8 possession process and rely on a valid legal ground for possession.

This may include situations where:

Property is needed by the landlord or their family
The landlord intends to sell the property
The tenant has rent arrears
The tenant has breached the tenancy agreement
The tenant has caused serious damage or engaged in antisocial behavior

What should landlords do now?

Review your tenancy agreements and understand which possession grounds may apply to your circumstances.

97 days to exchange. At what point does a slow property transaction become a deal risk?

A delayed transaction can create more than frustration. Mortgage offers can expire, circumstances can change, and opportunities can be lost when a transaction continues without clear progress.

The key is not simply moving quickly. It is identifying what is causing the delay and taking the right legal steps to keep the transaction moving.

Buying or selling a property? Speak to a property solicitor before delays become a bigger problem.

Remortgaging your home is more than simply switching lenders.

When you remortgage, your solicitor needs to ensure the existing mortgage is properly removed, the new lender’s legal requirements are satisfied, and the new charge is correctly registered.

A smooth remortgage depends on getting the legal details right from the start.

Planning to remortgage? Speak with Team Zaeem before making the switch.

A £25.00 ground rent cap may sound like good news. But is it enough to make your lease a good one?

Ground rent is only one part of the legal and financial picture.

Before entering into or relying on a lease, it is important to understand the wider terms, including your obligations, restrictions, rights and potential future costs.

A seemingly favourable figure does not tell the whole story.

Make sure you understand the lease before you commit.
