📢 UK IMMIGRATION UPDATE: LONG RESIDENCE

Changes to Appendix Long Residence provide for certain applications to be considered under family or private life routes.

✅ What has changed?
Where an applicant does not meet the requirements for permission to stay under Long Residence, but the Home Office considers they may qualify as a partner, parent or child under Appendix FM, or under Appendix Private Life, it will vary the application to the relevant route.

✅ Will another application fee be required?
No additional application fee will be required for this variation. The Home Office will contact the applicant to explain the change.

✅ What about the Immigration Health Surcharge?
Any required surcharge must be paid unless a waiver is requested and granted. Otherwise, the varied application will be rejected as invalid.

⚠️ These amendments concern Long Residence permission-to-stay applications. Variation does not guarantee approval or grant Indefinite Leave to Remain (ILR). Applicants must meet the requirements of the relevant route.

The new CPIN says low-level opposition supporters are generally unlikely to face a real risk, while journalists, prominent activists and outspoken government critics may attract adverse attention but must demonstrate individual risk. Where state persecution is established, effective protection and internal relocation are generally unlikely to be available.

Why it matters: Iraqi Kurdish claims require detailed evidence of the applicant’s profile, activities, visibility and previous encounters with the authorities; general opposition membership may be insufficient.

In KL v SSHD, the First-tier Tribunal accepted that the unrepresented Malaysian appellant was gay and would face persecution if living openly. It found that Kuala Lumpur was not a meaningful internal-relocation option because he had previously lived there, while national criminalisation, official hostility and the absence of effective protection applied more widely.

Why it matters: A CPIN’s general assessment must be applied to the individual evidence. Internal relocation cannot depend on concealing sexual orientation through fear. This is a fact-specific First-tier Tribunal decision and is not binding precedent.

HM Passport Office now directs examiners to refer post-30 September 1986 naturalisation or registration certificates that cannot be found on Atlas to its Quality and Examination Support team. The guidance also expands procedures for certificate amendments and checks involving the Channel Islands and Isle of Man.

Why it matters: A missing Atlas record should trigger internal verification rather than automatically defeating a first British-passport application.

🇬🇧 UK IMMIGRATION LAW UPDATE — HC 584

Important Changes to the Immigration Rules from October 2026

The Home Office published Statement of Changes to the Immigration Rules HC 584 on 3 September 2026, introducing a number of important amendments across the UK immigration system. Most of the principal changes take effect from 8 October 2026, with further changes commencing on 29 October, 30 November and 9 December 2026.

Key areas affected include:

* Skilled Worker route — amendments intended to support certain victims of modern slavery.
* Victims of Domestic Abuse — eligibility is extended to include qualifying adult dependent children, alongside other amendments to the route.
* EU Settlement Scheme (EUSS) — further amendments, including changes concerning evidence and documentation.
* BN(O) route — changes relating to the continuous residence requirements.
* Human Rights claims — removal of the application fee for certain human rights claims made by people within the Family Returns Process.
* Suitability requirements — clarification concerning breaches of immigration laws and conduct intended to frustrate immigration control.
* Fee waiver applications — important clarification concerning the date of application and subsequent applications following a fee-waiver request.
* Student route — maintenance requirements are being uplifted, with those changes taking effect from 30 November 2026.
* Minister of Religion and Religious Worker routes — relevant amendments take effect from 29 October 2026.

⚠️ Transitional Arrangements Matter

For a number of the changes commencing on 8 October 2026, applications, claims and administrative review applications made before 8 October 2026 will continue to be decided under the Immigration Rules in force on 7 October 2026. Similar transitional provisions apply to specified changes commencing on 29 October and 30 November 2026.

This means that the date an application is submitted may be particularly important when determining which version of the Immigration Rules applies.

At Khurshed Law Chamber (UK), we provide professional advice and representation in UK immigration, asylum, human rights and immigration appeal matters.

• Victims of domestic abuse: Appendix VDA will be extended to eligible adult dependent children whose relationship with their sponsor has broken down because of domestic abuse.

• Suitability: previous conduct intended to frustrate immigration control—including failing to report for immigration bail or absconding—may result in refusal.

• BN(O) settlement: eligible dependent children will no longer need to complete their own five-year continuous residence period where they can settle alongside qualifying parents.

• Further amendments affect the EU Settlement Scheme, human-rights claims, fee-waiver applications, religious workers and Student maintenance requirements. (gov.uk, gov.uk)

Most provisions commence on 8 October 2026. Religious-worker changes begin on 29 October 2026, the Student maintenance uplift on 30 November 2026, and specified EUSS biometric changes on 9 December 2026. (gov.uk)

The applicable Rules may depend on the application date and individual circumstances. Anyone potentially affected should obtain advice before submitting or varying an application.
