Tax Tip: Selling Art, Antiques or Jewellery? Know the CGT Rules

Capital gains tax may not apply, depending on what you’re selling and how much you get for it.

Wasting chattels. Items with a predictable life of 50 years or less, such as boats, clocks and w**e, are generally exempt. The exemption is lost if the item qualified for capital allowances in a business.

Non-wasting chattels. Fine art, antiques and jewellery are subject to the normal CGT rules, but there are useful reliefs:
→ If you sell an item for £6,000 or less, the gain is tax-free.
→ If you sell for more than £6,000, the taxable gain is capped at 5/3 of the excess over £6,000. In practice, this cap helps on sales up to about £15,000.
→ Selling a set piece by piece won’t get around the limit. HMRC treats a set as one item when the pieces go to the same person or connected people.

Coins. Britannias and post-1837 sovereigns are UK legal tender, so they are CGT-free however much they gain.

Gallantry medals. Selling or gifting a decoration for valour is CGT-free, unless you bought it yourself.

Wh**ky casks. Casks are usually treated as wasting assets because some wh**ky evaporates as it matures (the “angels’ share”). Private sales are therefore normally exempt. Be careful if you buy and sell casks regularly: HMRC may treat that as trading, which is taxed as income.
