World Financial Planning Day reminds us of the value of thinking ahead and putting plans in place for the future.

We're not a financial planning firm and do not provide financial planning advice.

However, financial plans often sit alongside important legal arrangements.

- A Will can set out how you would like your estate to be distributed.

- A Lasting Power of Attorney can give people you trust authority to make certain financial or welfare decisions if needed.

Today is World Alzheimer’s Day, an opportunity to raise awareness of dementia and the importance of support for people living with the condition, their families and carers 💜

Planning for the future can form one part of that wider conversation.

A Lasting Power of Attorney lets someone choose trusted people to make certain decisions on their behalf if they need support in the future.
There are two types: property and financial affairs, and health and welfare.

Crucially, the person creating an LPA must have the mental capacity to do so. A health and welfare attorney can then only make decisions once the donor is unable to make the relevant decision themselves.

Wills and other estate-planning arrangements may also be worth reviewing to ensure they still reflect a person’s wishes.

A Lasting Power of Attorney allows someone you trust to make certain decisions on your behalf, but it must be registered with the Office of the Public Guardian before it can be used.

Although you can wait to register until you need the LPA, doing so earlier can help you spot issues in advance and reduce the risk of delays when support is urgently needed.

Marcin Typiak joined our firm as a trainee solicitor in 2017 and qualified in 2019.

Marcin’s busy practice now centres on financial matters ranging from smaller and medium-sized cases to complex financial matters arising from the breakdown of marriages and partnerships, together with a range of Children Act matters involving allegations of domestic abuse and issues concerning the welfare of children.

An executor has an important responsibility to administer an estate properly and in accordance with the Will.

If concerns arise about how they are carrying out that role, it may be possible to apply to the court for their removal.

However, court action is not always necessary, and some disagreements can be resolved before matters reach that stage.

Concerns may arise where an executor is:

• Unreasonably delaying the Probate process
• Failing to make gifts or distributions set out in the Will
• Disposing of estate assets at significantly below their proper value
• Failing to maintain appropriate estate accounts
• Claiming unreasonable expenses from the estate

Removing an executor is a significant step, so you need to consider the circumstances and available evidence carefully.

In the last 12 -18 months, we have seen an increase in dissatisfied beneficiaries over concerns about executors failing to administer the estate. We have been successful in doing this under the Administration of Justice Act 1985.
