Navigating the UK Skilled Worker Visa with an Employer of Record

For businesses looking to tap into global talent and individuals aspiring to work in the United Kingdom, the Skilled Worker Visa offers a crucial pathway. However, the complexities of immigration law and sponsorship requirements can often be daunting. This is where an Employer of Record (EOR) can play a pivotal role, simplifying the process and ensuring compliance. This blog post will delve into how an EOR facilitates obtaining a UK Skilled Worker Visa and outline the core steps involved.

Understanding the Role of an Employer of Record (EOR)
An Employer of Record is a third-party organization that legally employs workers on behalf of another company, handling all employment-related responsibilities such as payroll, taxes, benefits, and compliance with local labour laws. In the context of international hiring, an EOR enables companies to employ talent in countries where they don't have a legal entity, significantly streamlining global expansion efforts.

For the UK Skilled Worker Visa, the EOR acts as the legal employer in the UK for a worker who will perform services for a client company (often referred to as the "end-user"). Crucially, the EOR must possess a valid Sponsor Licence issued by the UK Home Office to be able to sponsor foreign workers.

Core Steps to Obtain a Skilled Worker Visa via an EOR
The process of securing a UK Skilled Worker Visa through an EOR involves several key stages, ensuring both legal adherence and a smooth transition for the worker:

1.Eligibility Assessment:
The journey begins with a thorough assessment by the EOR. They verify that the job role aligns with the UK's Skilled Worker criteria, including the appropriate Standard Occupational Classification (SOC) code, and that the proposed salary meets the required thresholds. The candidate's qualifications, English language proficiency, and other personal eligibility criteria are also evaluated.

2.Service Agreement:
The client company, which will benefit from the worker's services, enters into a service agreement with the EOR. This contract outlines the terms of the EOR's engagement, including their role as the legal employer and their responsibilities in managing the worker's employment and visa sponsorship.

3. English Proficiency Test :
Many nationalities have to undergo an English SELTS test and obtain a level of at least B2 to qualify for the skilled worker visa. There are countries exempt from this but we will advise during the eligibility assessment.

4.Certificate of Sponsorship (CoS) Issuance:
Once the service agreement is in place and eligibility is confirmed, the EOR, as the licensed sponsor, assigns a Certificate of Sponsorship (CoS) to the worker.

5.Visa Application:
With the CoS in hand, we proceed to complete the application for the Skilled Worker Visa online. We will submit the CoS reference number along with other required documents, such as their passport, proof of English language ability, and financial evidence and the applicant then goes for Biometrics at one of the visa facilitation centres.

6.Right to Work Check:
Upon the successful grant of the visa, the EOR conducts a final right-to-work check to ensure all legal requirements are met before the worker commences employment in the UK. This is a critical step to prevent illegal working.

6.Ongoing Compliance and Management:
Throughout the employment period, the EOR manages all aspects of payroll, tax deductions, National Insurance contributions, and benefits. Furthermore, they handle ongoing reporting duties to the Home Office, such as notifying them of any changes in the worker's employment status or role, ensuring continuous compliance with sponsorship obligations.

It's important to note that salary thresholds are a critical component of the Skilled Worker Visa. As of recent updates, the general salary threshold has increased and it varies per category, though this can be lower for specific roles on the Immigration Salary List or for 'new entrants' to the labor market. Additionally, the salary must meet the 'going rate' for the specific SOC code of the job.
