The term making indecent images of children, which are the charges faced by are confusing to the non criminal lawyer because to be guilty you are not necessary required to be involved in the production of that image.

An image is made when a digital file is opened, whether it is a thumbnail on an internet page or an image received via email, social media page and messaging apps.

Other than those who have been prolific in downloading, possessing or sharing indecent images and videos of minors, most offenders are spared immediate custody, however having your name entered on the sexual offenders register and being subject to a sexual harm prevention order is a significant price to pay for opening an unsolicited message or clicking on a thumbnail.

In the last 18 months we have experienced an increase in clients prosecuted for illegal entry, whether they have been stopped at port of entry or subsequently arrested after submitting asylum claims, these are known as “small boat cases” ( even when they have arrived by other means ).
