The changes effective from 8 October 2026 may allow qualifying Skilled Workers to have their employment conditions amended following a positive Conclusive Grounds decision through the National Referral Mechanism made during their most recent permission. Suspected exploitation, a referral or unfair treatment alone is not enough. Do not rely on this provision to change jobs unless the Home Office has amended your work conditions. It does not automatically extend your visa or grant settlement; professional sportsperson/sports coach work remains excluded.

GRADUATE VISA GRANTED AFTER REFUSAL AND AN UNSUCCESSFUL ADMINISTRATIVE REVIEW

An initial refusal. An unsuccessful Administrative Review. A successful outcome following a Pre-Action Protocol challenge.

Our client’s Graduate visa application was refused, and that refusal was maintained following Administrative Review.

Shehzad Law Chambers Ltd pursued a challenge through the Pre-Action Protocol (PAP), asking the Home Office to reconsider its decisions.

The Home Office agreed to reconsider. Our client has now been granted permission to stay in the UK under the Graduate route.

This was not simply a successful first application. It was a case in which the refusal had already been upheld—and further representations were needed to challenge the decision.

A refusal is not always the end of the available options. The next step is to understand whether there are proper grounds for a challenge.

The Home Office refused thousands of citizenship applications last year, and most people didn't know they had a problem until the refusal letter arrived. Two reasons keep coming up.

One: absences from the UK over the limit.

Two: the good character requirement, which the Home Office rewrote in February 2025 and again in April 2026.

There's no appeal and you lose the fee.

🇬🇧 CONGRATULATIONS — A NEW BRITISH CITIZEN

Our client received their Certificate of Naturalisation and came to celebrate with the team at Shehzad Law Chambers.

It was not a simple case. Our client had been outside the UK for longer than the Home Office normally allows — one of the most common reasons for refusal. And since February 2025 the Home Office has twice tightened its good character guidance (most recently on 30 April 2026), so every applicant's immigration, tax and financial history is now examined more closely than before.

Mr Shehzad Sajid (Specialist Adviser) and Mr M. Waleed Arshad (Immigration Adviser) prepared full representations on the absences and completed a good character review before anything was submitted. Result: approved first time.

A refused citizenship application cannot be appealed, and the £1,839 Home Office fee is not refunded. If you hold ILR or settled status, get your case assessed before you apply — not after a refusal.
