Before you can trade mark a business name, you need to check if it’s available. You can do this by searching the trade mark databases, if they’re available in your country.

For businesses in United Kingdom, you can search the trade mark database on the IP UK government website: https://www.gov.uk/search-for-trademark.

If you’re not sure how to search the trade mark database, our team at Pulse Law can help.

But keep in mind, this search is only useful if you want to see if there is an identical or near identical mark. This search may not help you to identify similar marks that may still prevent your mark from being registered.

Remember a "mug" and a "cup" can be used interchangeably, but they don't look or sound the same.

A frequent misconception is that trademarks, copyrights, and patents all protect the same things.

However, there are significant differences between these three types of intellectual property.

Generally speaking, trademarks protect your company's name and logo. Copyrights protect your original works of authorship, including books, music, and artwork (but they can also protect a brand). Patents protect your inventions and ideas.

So, if you want to protect your brand, registering a trade mark is usually the best way to do so.

And if you have any original works of authorship or inventions, be sure to copyright or patent them accordingly.

If not, you may run into the following risks:
👉 The creator could sell your logo to another company, causing you future complications.

So, how do you avoid these risks?

Would this mean that you own the logo and any of the website assets?

Legally speaking, you may not own the logo or website content.
