We defended a businessman at City of London Magistrates’ Court after he was stopped by police and told he had no valid insurance.

Although the insurance company had cancelled his policy in August 2025, he had paid in full and genuinely believed his cover was still valid when driving. The police stopped him two and a half months later, creating a serious risk to his licence and driving record.

Case Victory – No Penalty Points Endorsed Despite Convictions

Luris Vince Solicitors successfully represented a licensed private hire driver charged with using a vehicle in a dangerous condition, contrary to section 40A of the Road Traffic Act 1988. The allegation related to both obligatory brake lights being inoperative.

Although the court ultimately returned a guilty verdict, we advanced a strong application under section 48 of the Road Traffic Offenders Act 1988. The Magistrates accepted plothat the defendant had taken exceptional precautions, including a garage inspection the day before and pre-journey checks on the day of the incident. They concluded that he neither knew nor had reason to suspect the fault.

As a result, no penalty points were endorsed, preserving our client’s professional driving licence. This outcome demonstrates the importance of careful preparation, early engagement of expert material, and robust advocacy.
