Taxation in the United Arab Emirates for Legal Entities

What is NFT and how it is regulated

NFT (non-fungible tokens) is digital property (pictures, audio tracks, videos, photos, and the like), as well as a set of certain rights to it (a special certificate with metadata). Ownership is proven using blockchain technology. It is a unique token that is stored in a blockchain, it exists in a single number and cannot be shared.

Revenue can be generated either by selling the NFT as a digital asset or through placing it in gaming and meta-universes. The original is used only once, when creating a token. In order to sell, a local copy is created, and its value drops with each iteration.
When you buy an NFT, you are not buying the work itself, but a token certificate that guarantees your rights to it. Anyone can download the object, but the data about you as the owner remains in the blockchain.

But because of its novelty, NFT is still difficult to regulate legally. It is not only a digital asset, but also intellectual property. And given the peculiarities of the Internet, the question arises — how do you protect your rights to NFT?

The state doesn’t regulate this segment yet, there are a lot of risks for offenses. You can’t physically steal a certificate, but you can copy a file and create your own token. One of the infringement options is the use of NFT objects without the consent of the right holder. In such a case, the owner can file a lawsuit for the elimination of the infringement of the intellectual property object.

So far, the court practice has not adapted to the solution of NFT problems, and this market remains in self-regulation mode. To protect their property, investors should pay attention to asset verification and transaction planning, choosing a jurisdiction to structure their investments.
