The UK government has announced its first law enforcement data adequacy decision, utilizing new post-Brexit powers, to facilitate the smooth transfer of personal data from UK law enforcement to authorities in the Bailiwick of Guernsey for law enforcement purposes. This decision aims to enhance crime prevention efforts and enable the prosecution of wrongdoers in Guernsey, while providing UK authorities with increased confidence and certainty regarding data regulation in Guernsey.

A law enforcement data adequacy decision is made when the government determines that a country, organization, or sector possesses the necessary data protection and privacy standards to effectively safeguard UK personal data. This decision allows for the transfer of personal data without the need for additional safeguards or specific authorization. The decision involves a comprehensive assessment of the country's legislation on data protection in the law enforcement sector, conducted in collaboration with the Information Commissioner's Office.

By declaring the Bailiwick of Guernsey's data protection standards as adequate, the UK government affirms the presence of robust privacy laws that ensure the protection of data transfers to Guernsey, while upholding the rights and safeguards of UK citizens.

This marks the UK government's inaugural law enforcement data adequacy decision following its departure from the European Union. Additionally, the UK government is currently progressing with law enforcement data adequacy assessments for the Bailiwick of Jersey and the Isle of Man, aiming to conclude these assessments in the near future. The UK already acknowledges the EU adequacy decision regarding both jurisdictions for UK GDPR (General Data Protection Regulation) purposes.

【UK’s first post-Brexit trade deals with Australia and New Zealand – Impact on UK Immigration – Youth Mobility Scheme】

Current Position
Nationals of Australia and New Zealand can apply for a Youth Mobility Scheme visa if they are aged between 18 and 30 on the date of application.
They must be able to demonstrate that they have at least £2,530 in their bank account to support themselves in the UK.
If the application is successful, the applicant will be granted a Youth Mobility Scheme visa for up to two years.

Key Changes to Youth Mobility Scheme visa
From 29 June 2023
- The age limit for New Zealand nationals coming to the UK under the Youth Mobility Scheme route will be increased from 30 to 35.
- They will be able to stay in the UK for up to three years.
- If they are already in the UK and hold a valid Youth Mobility Scheme visa, they will be able to apply to extend their current leave by one year.

From 31 January 2024
- The age limit for Australian nationals coming to the UK under the Youth Mobility Scheme route will be increased from 30 to 35.
- They will be able to extend their stay in the UK for up to three years.
