BREAKING:

๐Ÿ“ž๐Ÿ“žโฑ๏ธโฐUK Announces Biggest Immigration Overhaul in 50 Years

The New "Earned Settlement" Model โ€“ You Must Now EARN the Right to Stay Permanently

The UK Government (Home Secretary Shabana Mahmood) has just unveiled the Earned Settlement system as part of the Immigration White Paper. This replaces the old automatic 5-year path to Indefinite Leave to Remain (ILR / Settlement) with a contribution-based ladder that rewards high contributors and heavily penalises those who rely on public funds or break rules.

Expected to start in April 2026 (after consultation ends Feb 2026). Applies to most people already in the UK who haven't got ILR yet.

๐Ÿ”ด THE 4 CORE PILLARS OF THE NEW SYSTEM (THE GOVERNMENTโ€™S FOUNDATION)

1. Character โ€“ No criminality, no system abuse, no overstaying
2. Integration โ€“ English language, passing Life in the UK test, civic contribution
3. Contribution โ€“ Paying taxes, NOT claiming benefits, salary level
4. Residence โ€“ Continuous lawful time in the UK (longer = better)

๐ŸŸ  NEW QUALIFYING PERIODS FOR SETTLEMENT (ILR) โ€“ VISUAL TIMELINE BREAKDOWN

Category Old Rule NEW Qualifying Period Who it affects most

๐ŸŒŸ ๐Ÿ’ฌ CAN MY EX-WIFE PREVENT ME FROM SEEING THE CHILDREN IF I DONโ€™T PAY CHILD MAINTENANCE?

๐ŸŒŸNO! โŒ

๐Ÿ‘จโ€๐Ÿ‘ฉโ€๐Ÿ‘งโ€๐Ÿ‘ฆ Under UK Family Law (Children Act 1989), child maintenance and child contact (child arrangements) are treated as completely separate issues.
๐Ÿ‘‰ Not paying maintenance does NOT give your ex the right to stop you from seeing your children.

โš–๏ธ Hereโ€™s what you need to know:
๐Ÿ”น 1๏ธโƒฃ Contact and Maintenance Are Separate Matters:

Your relationship with your child should never depend on whether maintenance is paid.
The law protects your right to have contact, provided itโ€™s in the childโ€™s best interests.
๐Ÿ”น 2๏ธโƒฃ Struggling to Pay?

If youโ€™re having financial difficulties, contact the Child Maintenance Service (CMS).
They can review your situation and adjust your payments if necessary.
๐Ÿ’ก Non-payment should never be used as leverage to block contact.
๐Ÿ”น 3๏ธโƒฃ What If Your Ex Is Denying Contact?

You can apply for a Child Arrangements Order (Form C100) under Section 8 of the Children Act 1989.
๐Ÿ’ฌ The court may first ask you to attend mediation (MIAM) unless thereโ€™s evidence of abuse or other exemptions.

๐Ÿ”น 4๏ธโƒฃ Courtโ€™s Focus: The Childโ€™s Welfare ๐Ÿ‘ถ

The court always considers whatโ€™s best for the childโ€™s wellbeing (Section 1(3)).
Thereโ€™s a presumption that both parentsโ€™ involvement benefits the child, as long as itโ€™s safe (Section 1(2A)).
๐Ÿ”น 5๏ธโƒฃ Legal Options if Contact Is Blocked:

โœ… Apply for an interim order if itโ€™s urgent
โœ… Seek enforcement through a Specific Issue Order or Prohibited Steps Order
โœ… Get professional help from a family law solicitor or Citizens Advice
๐Ÿ’” If your ex continues to withhold contact without valid reason, the court can take this seriously โ€” and may even change living arrangements in extreme cases.

โœจ Remember:

Children benefit from having both parents in their lives โ€” and the law supports that.
If youโ€™re being unfairly denied contact, donโ€™t stay silent. There are legal steps you can take. ๐Ÿ’ช
