There’s a lot of attention on Amarin Pharmaceuticals Inc. v. Hikma Pharmaceuticals USA Inc. ahead of oral arguments at the U.S. Supreme Court this month.

The case concerns Hikma’s use of a “skinny label” to bring a generic version of Amarin’s drug to market.

Writing about the case in Law 360, Spencer West US Intellectual Property Partner Jonas McDavit reframes the case not just as a technical dispute, but about the tension between “property” and “home” in intellectual property law.

The U.S. Court of Appeals for the Federal Circuit didn’t just look at the label (the “property”) - it looked through a more human lens (the “home”), that being the investment, the intent and the value behind the innovation.
