In most circumstances, employees cannot be summarily dismissed, unless perhaps where gross misconduct has occurred. At the very least, proper notice under the contract of employment must be given but in order to bring a claim for unfair dismissal, an employee must have worked for the employer continuously for at least 2 full years. This is known as the “qualifying period”. However there it is possible to bring a claim for unlawful discrimination even when the employee has not worked for the employer for two years, is the discrimination is by reason of:


- Age
- Disability
- Gender reassignment
- Marriage and civil partnership
- Pregnancy and maternity
- Race
- Religion or belief
- S*x
- S*xual orientation

Every case needs to be assessed on its merits but we can usually quickly work out whether the amount of compensation offered in a draft settlement is reasonable or not.

Damages for unfair dismissal are currently limited at £194,659 or 52 weeks gross pay, whichever is the lower. Damages for unlawful discrimination can be unlimited.
