PERSONAL INJURY COMPENSATION CLAIMS RELATING TO BUS ACCIDENTS

I have dealt with many successful compensation claims relating to bus accidents. Bus accidents arise for a number of reasons. In many cases, a bus driver won’t be responsible for the accident and the claim has to be brought against the driver of another vehicle, for example, where a van or car pulled out of a minor road into the path of a bus, a vehicle changed lanes abruptly and caused the bus driver to apply emergency braking, where a vehicle pulls out from a parked position into the path of the bus, or other cases where a vehicle collides with the bus.

There is no automatic right to compensation for personal injuries and other losses sustained as a result of a tripping accident. Where the accident occurs on a publicly maintained pavement or road, the local authority responsible for maintaining the pavement or road has an obligation under the 1980 Highways Act to maintain and repair the pavement/road. The Well Maintained Highways Code of Practice for highway maintenance management was updated in May 2013 and provides guidance as to how often local authorities should inspect pavements and roads and when they should carry out repairs.

PERSONAL INJURY COMPENSATION CLAIMS RELATING TO THE USE OF LADDERS AND STEPLADDERS.
I have dealt with a large number of personal injury claims arising out of the use of ladders and stepladders at work. The Work at Height Regulations 2005 states that every employer shall ensure that a ladder is used for work at height only if a risk assessment under Section 3 of the Management Regulations has demonstrated that use of more suitable work equipment is not justified because the risk is considered low, the ladder is intended for use for only a short period and because of existing features on the site, it is impractical to use alternative equipment.
