Adding a partner to your deeds? Taking a name off after a relationship ends?

Both usually come down to a transfer of equity.

Equity is the share of the property you own, worked out as the value of the home minus what's left on the mortgage. A transfer of equity changes who owns that share and updates the legal title at HM Land Registry. Nobody is buying the property, so there's no chain involved.

We see them most often when people get married, add a partner to the title, separate, or take a name off after a relationship ends.

If there's a mortgage, your lender has to agree to the change. The person staying usually needs to show they can manage the mortgage alone, and the person leaving will want to be sure they're properly released from it.

Adding someone new? It's also worth agreeing how you'd each share the value if you ever sold. A Declaration of Trust records that in writing.

Our conveyancing team can talk you through how a transfer of equity works for your situation, and explain each step along the way.

When did you last check whose names are on your property's title?

Spotted the phrase "Section 106 Agreement" on paperwork for a property you like the look of? It's worth understanding before you go much further.

These agreements are attached to planning permission and can bring obligations or restrictions with the property itself, not just the land it sits on.

For buyers, that might mean rules around who's eligible to live there, affordable housing conditions, financial contributions tied to the wider development, or limits on how the property can be used. Some of these obligations carry on even after you've bought the place, whoever owns it next.

That's exactly the kind of detail your conveyancer checks and explains before you commit to anything.

Have you come across a Section 106 Agreement on a property you've looked at?

If you're buying your first home, paperwork is usually the thing that catches people out, not the conveyancing itself.

Mortgage documents that arrive later than expected, ID checks that haven't been completed, or evidence for a gifted deposit that's still being pulled together can all push a moving date back by weeks.

Getting these ready early, before your solicitor even asks for them, keeps everything moving at the pace it should.
Has paperwork ever slowed down a move for you or someone you know?

Getting a helping hand from family for your deposit?
That's genuinely lovely news, but it does mean a bit more paperwork before completion.

Solicitors have to follow strict anti-money laundering rules, and that includes checking exactly where every penny of your deposit came from. If part of it's a gift from parents, grandparents or anyone else, we can't just take your word for it.

We'll need a formal gift letter confirming the money's a gift and not a loan, along with ID for whoever's giving it. We'll also need evidence of the source of funds and source of wealth via bank statements and supporting evidence. It can feel like an odd hoop to jump through when someone's just trying to help you onto the ladder, but these checks protect everyone involved, including the person doing the gifting.

The earlier you let us know a gift's coming, the sooner we can get that paperwork sorted and out of your way.

Probate sales, and why the order of things matters...

Probate sales aren't like a standard house sale. You're often dealing with more than one personal representative, working out what happens to a property as part of someone's estate, and balancing what other beneficiaries need alongside everything else that comes with a normal transaction.

There's paperwork tied to the Grant of Probate, and until that's been issued, the sale usually can't complete. Getting the order of steps right matters here, especially when the family involved is already dealing with a lot.

We handle probate sales alongside our standard conveyancing work, so we know what to look out for early on. A missing document or a wait for the Grant to come through can slow things down, so spotting that early makes a real difference to how smoothly everything runs afterwards.

These sales often happen at a genuinely difficult time for the people involved. Clear communication and a bit of patience matter just as much as getting the legal side right.

Ever spotted "unadopted road" in a property listing and wondered what you were actually signing up for?

It just means the road or path leading to the property isn't maintained by the council. It's private, which raises a couple of things worth sorting out early.

Who's actually responsible for keeping it in decent condition? And do you have a proper legal right to use it to get to your own front door?

Our conveyancing team checks both of these as standard, so you know exactly where you stand before you complete, not after you've already moved your boxes in.

Have you ever bought or viewed a property on a private road, and did you know what to ask about it at the time?

Verifying who you are shouldn't be the hardest part of buying a house.

At Apex Law, ID checks are done digitally, so you can get yours sorted whenever it suits you. Morning coffee, lunch break, last thing before bed, it doesn't matter. No need to print anything, scan it in, or post original documents back and forth.

It's a small thing, but it makes a real difference early on. The quicker your identity's confirmed, the quicker we can get properly stuck into your file instead of waiting on paperwork to catch up.

Would you rather handle ID checks online in your own time, or still like the reassurance of a paper trail you can hold onto?

MYTH: New-build properties are easier to buy because they're new.
New key, new walls, new everything. Surely the legal side is just as fresh and simple?

Not quite. A new-build purchase brings its own paperwork, and it's not always lighter than buying an older property. The developer's solicitor works to the developer's contract terms, not yours, and those terms are often less flexible on timing than a private seller would be.

Mortgage offers on new builds can carry their own deadlines too, tied to when the property's actually ready rather than when you'd like to move. If completion slips, that offer needs watching closely.

Leasehold new builds add another layer. Service charges, management company details and ground rent terms all need proper checking before you commit, the same as any leasehold purchase.

None of this means new build is a bad choice. It just means "new" and "straightforward" aren't the same thing, and having someone who knows what to look for makes a real difference.
