!!!⚖️ Proposed Changes to Inheritance Rights for Unmarried Couples ⚖️!!!

The Government is currently consulting on proposals that could significantly change the legal position of unmarried couples in England and Wales.

Many people are surprised to learn that there is currently no such thing as a “common law spouse”. If an unmarried partner dies without a Will, their surviving partner does not automatically inherit from their estate, regardless of how long they have lived together.

The proposals under consideration could give certain cohabiting couples rights that are closer to those enjoyed by married couples and civil partners, including:

• Potential inheritance rights where a partner dies without a Will.
• Easier access to financial provision from a deceased partner’s estate.
• Greater legal protection for long-term cohabiting partners.

At present, these are only proposals and the law has not changed. However, the consultation highlights the increasing recognition of modern family arrangements and the difficulties faced by many unmarried couples.

In the meantime, the best way to protect your partner remains to have an up-to-date Will in place. Without one, the current intestacy rules may not provide for your partner as you expect.

If you are living with a partner and would like advice on Wills, estate planning or protecting your loved ones, please get in touch.
