Public inquiries are often established to learn lessons, improve systems, and prevent future harm. But what happens when their recommendations are not implemented?

In this insightful blog, Ben Harrison examines the routes available to challenge or influence Government decisions where inquiry recommendations are not acted upon, including judicial review, ongoing inquiry oversight, and parliamentary scrutiny. A thought-provoking read on accountability, governance, and the lasting impact of public inquiries.

A recent article in the Law Society Gazette highlights a striking trend: more individuals are paying just £3 to block probate applications, effectively putting estates on hold for six months.

On the face of it, the low cost and accessibility of lodging a caveat may seem like a safeguard. But in reality, it underlines a growing problem: estates are becoming increasingly vulnerable to delay, dispute, and uncertainty.

We are seeing more families drawn into contentious probate, often at an already difficult time, with challenges arising around capacity, undue influence, or simply unmet expectations. The ease of entering a caveat only adds to this risk.

This is where the importance of properly instructing a solicitor to prepare your will cannot be overstated.

A professionally drafted will is not just about recording wishes, it is about:

• ensuring clarity and legal validity
• reducing the risk of disputes
• protecting executors from unnecessary challenges
• giving families certainty when they need it most

In a landscape where it costs less than a coffee to delay the administration of an estate, the value of robust legal advice at the outset is clearer than ever.

Planning ahead isn’t just sensible - it’s essential.
