‘I just need a simple contract’.
This was a request I had this week.
Translation: I don’t want to pay very much for the document to be prepared or I really don’t understand that contracts are not ‘simple’.
It’s also why I think a lot of people are using AI to prepare their own documents. They think it’s all ‘simple’.
Most clients dont think about what happens if it all goes wrong, including when someone tries to terminate the contract before it legally ends, when someone doesn’t want to pay, when someone doesn’t fulfil their obligations, when the obligations are unclear, when some terms of the contract are actually unenforceable and many other reasons that could signal problems ahead.
This is what I do. Whether it’s driver or teams agreements, sponsorship contracts or any other contract within the motorsport world, I make sure I understand the basis of the agreement and what is expected of both parties and what will happen if it goes wrong. It makes life so much easier if there are issues in the future.
With over 30 years of experience, I’ve pretty much seen it all and what happens if things do go wrong and the contract simply wasn’t well prepared or, even worse, there isn’t a contract in place!
Getting the contract right at the beginning is absolutely essential.
Contracts are very much not simple!

Fridays are normally the end of the week for most people … but not me! It’s mid week for me as I’m on call all weekend.
This weekend is for a young up and coming driver who has high aspirations and wants to make sure he has the most effective weekend with no issues. If any issues do come up, he wants someone on hand who knows both the General Regulations and the specific Championship Regulations inside and out - and the appeal process if it’s needed. He can then go into the weekend knowing he is prepared for anything.
Knowledge is power.

Contracts in motorsport are essential - and they need to be right and include everything that is part of the agreement.

A decision was given yesterday at the High Court where Alex Palou was ordered to pay McLaren Racing more than $12 million for breach of contract.

The decision follows a five-week trial held in October last year after McLaren sued Palou for backing out of two separate agreements.

The claims stemmed from Palou’s decision to remain with Chip Ganassi Racing rather than move to McLaren’s IndyCar team.

The court ruled that all awarded damages were limited to losses suffered by McLaren’s IndyCar team as a result of Palou’s reversal. Part of the claim for F1 losses was dismissed in the 124 page judgement. The majority of the damages awarded to McLaren were tied to sponsorship-related losses.

Alex Palou is now considering whether to appeal the decision.

Supreme Court upholds Kris Meeke's title.

"Any foreigner can become a national champion in an individual sport."

The Portuguese Supreme Constitutional Court (TC), the highest court in the portuguese judiciary, decided not to rule on an appeal by the Public Prosecutor's Office against a decision by the Court of Arbitration for Sport (TAD) that awarded the national championship title to British driver Kris Meeke.

In the ruling issued on November 6th, Judge Afonso Patrão justified the decision not to "take cognizance" of the appeal by stating that the TAD awarded the Portuguese championship title to a foreigner citizen not only based on two articles of the Portuguese Constitution, but also on European law.
According to the judge, it would be "useless" to analyze the issue because "a possible negative judgment of unconstitutionality" would leave "the decision untouched."

In other words, in the future, if any foreigner becomes the Portuguese champion in an individual sport, they can always invoke the TAD decision, but also this Constitutional Court ruling that leaves everything unchanged.

But what is really at stake?

Kris Meeke, who was born in Northern Ireland and is a British citizen, was the highest-scoring driver in the national rally championship last season, driving a Hyundai for Sports & You Rally Team.

However, the National Automobile and Karting Federation did not award him the championship title based on the legal framework governing federations, which stipulates that: “In the case of individual sports, titles can only be awarded to national citizens.”

And, “agreeing or not,” the federation did not award the championship title to any driver.

Meeke's team appealed to the Court of Arbitration for Sport, which overturned the FPAK's decision with two arguments: the rule governing the legal framework of federations is “unconstitutional” and goes against “European Law.”

As always happens whenever the constitutionality of a rule is questioned, the Public Prosecutor's Office took the case to the Constitutional Court, and the Deputy Attorney General of the Republic, Luís Eloy, issued an opinion contrary to that of the TAD.

According to this magistrate, “it is legitimate to reserve the title of national champion for a national, given that nationality can be considered an inherent characteristic of the national champion title.”

He explained: “The title aims, after all, to determine the best national athlete. It is a justified differentiation. One cannot be a national champion if one is not a national.”

And he cited the example of cycling: “Another interpretation could lead the Slovenian Tadej Pogačar to be champion in several countries in the same year.”

But Afonso Patrão did not analyze the substantive issue, contradicting the position of Luís Eloy, who argued that the TAD ruling was limited to citing “a ruling of the European Court” and not a “specific norm.”

The immediate result of this non-decision by the Constitutional Court is that Meeke retains the 2024 title and the 2025 champion, the Spaniard Daniel Sordo, will not see his title questioned.

Tribuna Expresso contacted the Ministry of Culture, Youth and Sport to find out if there will be any changes to the legal framework of federations, considering the decisions of the TAD (Arbitration Court for Sport) and the TC (Constitutional Court).

According to the Secretary of State for Sports, Pedro Dias, "the reading of the ruling does not reveal that the Legal Regime of Sports Federations contains any unconstitutional provision."

In other words, there will be no change.

Although this issue only reached the TC because of rallies, there are other sports in which foreigners have been crowned national champions and the courts have intervened: in 2016, the national title for sport dance pairs was awarded to a foreigner and a Portuguese woman.

Despite these being pairs events, sport dance is considered an individual sport, and the federation withdrew the title from the pair.

The TAD intervened after a complaint from the athlete, and the federation ended up reversing its decision.

Abreu Advogados, which represented Meeke's team in this case, believes that "the Constitutional Court's decision represents an affirmation of the values of sports justice and constitutes a relevant precedent for the development and fairness of national sports competitions."

Latest decisions by the FIA World Motor Sport Council concerning karting

At its meeting on 16th October 2025, the FIA World Motor Sport Council (CMSA) adopted a series of decisions that will shape the future of international karting, marked by a renewed commitment to innovation, safety and sustainable development.

Major advances for e-karting

The FIA has taken a new step forward by adopting technical and homologation regulations for the Junior and Senior categories of e-karting, complementing the specifications for Mini e-karting introduced in 2023.
The new provisions set out, in particular:
- A maximum voltage of 60V;
- The requirement to position the battery centrally, under the steering column;
- A maximum power output of 23 kW in Junior and 28 kW in Senior;
- New standards for the homologation of e-drivetrain systems.
