Giovanni Chiarini is currently a Lecturer at the University of Huddersfield, and scholar-in-residence at Texas Tech University (USA). Giovanni is a Barrister-At-Law (Bar Council of Piacenza, Italy), admitted to the list of Assistants to Counsel (Conseils Adjoints) of the International Criminal Court (The Hague), an International Fellow of the Institute of Military Justice (Washington DC), as well as an assistant lecturer at Insubria University (Lake Como, Italy). He carried out legal consultancy for the Supreme Court of the Extraordinary Chambers in the Courts of Cambodia (ECCC), with the United Nations Assistance to the Khmer Rouge Trials (UNAKRT). 📢 Publication Alert! 📚 Thrilled to share that my latest article has been published in the Case Western Reserve Journal of International Law, Cleveland, USA, spanning pages 239-270. Titled "Ecocide in War and Peace: From the Air Pollution Consequences of the War in Ukraine to Japan's Disposal of Fukushima Water into the Ocean," the article's title draws inspiration from Tolstoy's monumental work "War and Peace."

In this article, I delve into the analysis of these two potential cases of ecocide, exploring avenues for prosecution and proposing targeted amendments to the International Criminal Court Rome Statute. These amendments aim to ensure environmental expertise at the international judicial level by advocating for the inclusion of expertise in environmental law, climate change law, international law of the sea, and animal law in the requirements for the election of 1/3 of judges. Additionally, I advocate for the establishment of the "Office of the Special Prosecutor for the crime of Ecocide" and suggest changes in the composition of the bench of judges to strengthen criminal procedure knowledge and practical expertise.

But more importantly, this volume features contributions from illustrious scholars in the field, including Professors Leila Sadat, Milena Sterio, Dr. Paul R. Today, on Earth Day, I had the privilege of leading a masterclass where we delved into the topics of ecocide and the procedural complexities within the International Criminal Court concerning the war in Ukraine, engaging with the brilliant students of Paris
Sciences Po University, Menton campus.
I have high hopes that this generation of law students will play a significant role in advocating for the inclusion of ecocide as the fifth international crime in the Rome Statute.
It was unfortunate not to be present at the Menton campus on the Côte d'Azur, but I'm confident that there will be other opportunities in the near future! 🌍🌿⚖️

Our NIMJ submission to the International Criminal Court - ICC Prosecutor is now accessible!

I'm delighted to be a part of the National Institute of Military Justice (NIMJ) in Washington DC. Alongside the institute's Director, Philip Cave, President Franklin Rosenblatt, and my esteemed colleagues International Fellows Anne Dienelt and Shruti Bedi, we've submitted our reflections on the ICC environmental crimes policy.

NIMJ aims to underscore three key points for the ICC OTP’s policy initiative on environmental crimes without necessitating further amendments to the Rome Statute:

1. The environment as a civilian object

2. Direct and indirect protection of the environment in armed conflict

3. Integrating psychological research on 'ecological grief,' 'environmental melancholia,'
and 'solastalgia,' into sentencing for environmental crimes according to Art. 78(1) of the Rome Statute.

I am delighted to have received the printed copies of my latest article, co-authored with the former Vice President of the International Criminal Court, Honorable Cuno Jakob Tarfusser, published in Volume 56 of the Texas Tech Law Review!

This paper builds upon the discussions from the International Criminal Law Symposium held in Texas last year.

ABSTRACT: In this Article, Cuno Jakob Tarfusser and Giovanni Chiarini will explore and propose our view on the main procedural challenges of the ICC investigation into the situation of Ukraine, namely (1) the procedural issues related to the preliminary examination, which are only apparent since the preliminary examination framework itself is based on extra juridical rules; (2) the insurmountable issues related to a de facto lack of declaration of acceptance of jurisdiction and the lack of Rome Statute membership; and (3) the inherent procedural weaknesses that characterize the ICC statutory law as a whole, specifically its composition, which could negatively impact the efficiency of the entire proceeding.

With 39 votes out of 108 I have been elected at the International Criminal Court Bar Association, the only recognised representative body of counsel at the International Criminal Court in The Hague.
To be honest, I expected four or five votes only and I was amazed to be elected for two different committees: the training committee and the amicus curiae (actually my favourites and what I was running for).

My recent and ongoing academic activities (July/October 2023) after having moved to the University of Huddersfield as a permanent lecturer:

- Finalizing the article for the Texas Tech University Law Review, on the procedural weaknesses of the ICC investigation in the Russo-Ukrainian war, written together with the former International Criminal Court Vice President

- Preparing my conference presentation on the evolution of ecocide and international crimes against the environment for the Case Western Reserve University Conference in the US, Ohio, in September 2023, and submitting the paper for their International law review

- Preparing a guest lecture (I'll be discovering the topic later) for Georgetown University in Washington DC in September 2023

- Preparing my conference presentation on ecocide and International Criminal Court at the UniTe / Università degli Studi di Teramo conference in October 2023

- Organizing a guest lecture for Miami Dade College, to be held either this or the spring term (work in progress!)

- Inviting the former International Criminal Court Vice President to our University of Huddersfield International Study Centre for a keynote lecture

In the meantime, working on my LLM lectures and seminars in International Criminal Law and Public International Law for my students and dealing with my legal profession and consultancies as well!!
