Many people fear the idea of having to appear in court when making a claim, which is completely understandable.
But the reality is that most cases are settled out of court. Here's why:
➡️ Strong cases win early - solicitors take on claims with a strong chance of success, which usually means the other side accepts responsibility before the case goes to court.
➡️ Everyone wants to reach an easy resolution - both sides generally want to avoid the extra time, stress and costs of a court trial.
➡️ Negotiation doesn't stop - even if a court date is set, solicitors will continue negotiating to try and reach a settlement beforehand.
Court is typically reserved as a last resort for complex cases or those where the other side has refused to accept responsibility.
