Who decides who a child should live with?

In the process of separating from the parent of your child, you may wonder who the child should live with. In the absence of an agreement between the parents, the Court may decide who the child should live with on the basis of what would be in the child’s best interests.

Parents can agree between themselves how to divide custody of the child, including where the child will primarily reside and how much time they will spend with the non-resident parent. However, in the event that the parents disagree on the division of custody, they can ask Court to make the decision.

“… over 60% of those with depression consider relationship problems to be the main cause of their illness.” is the statistics provided by the mental health charity Relate.

Our experience shows that when we are facing such predicament, apart from the emotional turmoil, we feel overwhelmed with the mountain of procedures, laws and formal decisions we need to make, and a huge sense of loneliness in facing the battle ahead. Often all we need is someone to talk to so we can get an understanding of where we stand and get some clarity. However, regardless of affordability, reaching out to experts for a paid consultation often forms a barrier for many people.

As we are approaching Mental Health Day on 10th October, we are launching our “You Are Not Alone” campaign in support of people who are in this position as well as supporting the local mental health charity U OK?

We will be offering free consultations on all family law matters until the end of October and will donate the cost of such meetings (of up to £250 each) to “U OK?”. Should matters require further assistance beyond the initial free consultation, we will also provide a 10% discount on the related legal fees until Christmas 2023.

If there is anyone you know that may benefit, then please share this with them. All matters will be handled with strict confidence.
