New family law service now available at HRJ Foreman Laws Solicitors

We have launched a new One Couple, One Lawyer service for couples who want to handle divorce, civil partnership dissolution or separation in a constructive and cooperative way.

This approach allows one specially trained solicitor to advise both people together, helping them understand their options and work towards fair arrangements for finances, property and children.
The service is led by Roger Weller, our experienced family law solicitor trained in the Resolution Together approach.

It is designed for couples who are separating on reasonably amicable terms, are able to be open about finances, and want to avoid unnecessary conflict. It may not be suitable where there are concerns such as domestic abuse, coercive control, major imbalance of power or lack of financial transparency.

As more couples look for practical alternatives to adversarial divorce, this new service offers a calmer and more constructive route through separation.

Myth 1 - My next of kin can make decisions for me

Next of kin sounds official.

But legally it is often much less powerful than people think.

Being someone’s next of kin does not automatically give a spouse, partner, child or parent the right to access bank accounts, manage property, pay bills, speak to financial institutions, or make health and care decisions.

Hospitals and care providers may speak with close family members, but that is not the same as having legal decision-making authority.

For that, you need a valid Lasting Power of Attorney (LPA.)

By putting a LPA in place, you are legally authorising someone you trust (your Attorney) to act on your behalf.

You need two separate documents to cover all aspects of your life:

⭐ Property & Financial Affairs LPA – Grants power over your bank accounts, property, investments, and savings.

⭐ Health & Welfare LPA – Grants power over your medical treatment and care decisions, including, should you wish, life-sustaining treatment.

Found a business you would like to buy?

The hard part is not over yet.

Before making an offer, take a step back and check what is really being sold.

Are you buying the company itself, with its history and liabilities, or just the business assets? That distinction can have a major impact on risk.

Next, look at why the business is being sold, whether the asking price is fair, and whether the figures support the story. This is where an accountant and, in some cases, a valuer can be invaluable.

Once the deal becomes serious, it is time to contact us. Our experienced company and commercial solicitors can help review the structure of the deal, carry out legal due diligence, advise on heads of terms, and make sure the purchase agreement properly protects you against hidden liabilities or inaccurate information.

Buying a business is not just about agreeing a price. It is about understanding the risks, checking the detail, and putting the right protections in place before completion.

We are separating, do we need a separation agreement?

A separation agreement is a written agreement between a couple who have separated, or are about to separate, which records what has been agreed about finances, property finances, property and arrangements for children.

It can be a helpful option if you are living apart but are not ready to divorce, or if you want to set out arrangements before divorce proceedings begin.

A separation agreement can cover:

✅who stays in the family home
✅mortgage and household bills
✅savings, debts and joint finances
✅ arrangements for children
✅personal possessions
✅intentions around pensions.

In England and Wales, a separation agreement is not the same as a court-approved financial order. It can carry significant weight if properly prepared, but it does not give the same finality or clean break as a financial consent order made during divorce.

For some couples, it provides clarity and breathing space. For others, immediate divorce and a financial consent order may be the better route.
