I had a call from a lady wanting a quote for a single will. I gave her the price. She said that was too expensive and that she had been quoted £47. Could I match that. I told her £47 will get you a slick salesperson in your house and you will end up spending a lot more than £47. I know this because I write wills for a chap who does this and I charge him a lot more than £47 and he’s doing very well.

Some good news. The Property (Digital Assets etc) Act 2025 came into force on the 2nd December 2025. Previously English Law only recognised 2 forms of personal property. Physical items you posess (ie car, house) and items through legal action ( post office scandal for example). Digital assets (ie crypto) were a grey area and were often overlooked by executors and ended up in limbo. Digital assets include Crypto currencies, NFTs (digital art or collections), Tokenised assets (digital shares) and in game or platform tokens that have a value or can be traded. What the Act doesn’t cover are social media accounts, email accounts and subscription accounts (music, films) which are licensed to the user.

In the past months I have been including a digital asset clause as standard within the wills I write. If you have these digital assets and they aren’t included in your will then you may want to consider updating your will.

After a robust check by the Society of Will Writers, I continue to be compliant with their code of operation. This means I have all my policies and procedures in place and safe to do business with. I even get an id card which I must keep with me.

A week of ups and downs. An enquiry from a chap whose dad has been diagnosed with dementia. They’ve been meaning to get lasting power of attorney in place but haven’t had the time. If I had a pound every time I heard that. Some power of attorney documents came back from the Office of the Public Guardian (OPG) today. All stamped and ready to be sent to my clients. The registration process is taking around four months now. Used to be five to six sometimes longer. The OPG receive around 3,800 applications a day.

I’ve been sorting out a will and power of attorney for a gentleman currently going through a divorce. It important to remember that marriage nullifies a will but divorce doesn’t. We’ve done a basic will for him but may have to amend this once the divorce is complete. The reason is that his estate will be well over the inheritance tax allowance plus he has one son. When the son inherits, this will take him over the inheritance tax allowance. By using trust law within the will, we can reduce his tax liability.

Another interesting week. Single will for a gentleman who wanted to make sure one of his daughters wouldn’t inherit as he hasn’t seen her for over 25 years. The Will included a clause stating this so it cannot be challenged that this was an oversight.
