NEW RULES FOR TAKING POSSESSION AND EVICTING TENANTS

The stay on all possession proceedings has ended on 20 September 2020. Although the stay has ended any pending possession claim will not automatically progress. Under the amended CPR provisions Claimant's must serve a ' reactivation notice' in order to progress with the pending claim.

It is likely that there will be significant backlog of claims and the court are likely to prioritise claims that are pending.
For any new claims it should be noted that from the 29 August 2020 landlords must give tenants 6 months notice before they apply to court to end a regulated tenancy. The protection shall be in place until 31 March 2021. There is an exception in certain cases which include,

Over 6 months arrears ( 4 weeks notice is required)

Anti social behaviour ( 4 weeks notice is required)

False statements (4 weeks notice is required)

In addition to this landlords will now need to include information in respect of the tenants circumstances and any likely impact of Covid 19.

Notices served on or before August 28 are not effected ( 3 months notice was required).
