Law Article: How the Law Deals with Hidden Assets

When a marriage or civil partnership comes to an end, the legal system strives to ensure that financial matters are settled in a way that is fair and just to both parties. This process depends on honesty, transparency, and cooperation. But in some cases, the breakdown of trust that accompanies the end of a relationship extends into the financial negotiations, particularly when one party seeks to hide assets or frustrate the settlement process.

Whether through concealed bank accounts, undervalued businesses, or hidden cryptocurrencies, attempts to obscure financial resources can severely undermine a fair outcome. Fortunately, the law provides powerful remedies, such as freezing orders and search orders, to prevent misconduct, preserve assets, and ensure that court judgments remain enforceable. With the right legal support, clients can protect their interests while upholding their legal obligations.

Law Article: Divorce and Civil Partnership Dissolutions After 50

Divorce or the dissolution of a civil partnership can be emotionally and financially challenging at any age. However, for individuals over the age of 50, the stakes are often higher and the issues more complex. With retirement on the horizon or already underway, and significant financial assets potentially accumulated over decades of marriage or partnership, separation later in life, often referred to as “grey divorce”, requires careful legal and financial planning.
This age group must consider several unique factors, including pension division, long-term financial independence, property arrangements, and health or capacity issues. Unlike younger couples, there is usually less time to rebuild financially after separation, making the terms of the final settlement critically important. The legal principles applied by the courts are the same, but their impact on older individuals can be significantly different.

Law Article: Understanding Home Rights Dering Marriage or Civil Partnership
Home rights are a vital legal safeguard under the Family Law Act 1996, designed to protect individuals in a marriage or civil partnership who do not legally own the home in which they reside. These rights provide security of occupation and help prevent a non-owning spouse or civil partner from being excluded from the family home without a court’s permission. While home rights are not a form of property ownership, they serve as an essential protective mechanism during a legally recognised relationship and in times of marital or partnership breakdown.

A massive thank you to the amazing Rock Choir for filling Hyde Park with music, joy, and energy at the Race for Life yesterday. We may have had to hit the pause button on our race to stop and soak it all in, but it was definitely worth the extra time. Who says you can’t run AND enjoy a concert? 😀
