Why CW5 “Help with Family Mediation” Is So Important in Family Mediation

Many people think that once they’ve reached an agreement in family mediation, the hard work is done — and in many ways, it is. You’ve had the conversations, made the decisions, and found a constructive way forward.

But there’s a crucial final step that often gets overlooked.

To make your agreement legally binding, you usually need a solicitor to review it and draft the Consent Order.

This is exactly where the CW5 – Help with Family Mediation funding comes in.

CW5 provides free legal advice during and after mediation for those eligible for Legal Aid. It allows a solicitor to:

✔ Review your proposals

✔ Advise you on your legal position

✔ Draft the Consent Order so you can finalise everything properly

✔ Support you with the “after mediation” process that many people struggle to navigate alone

Without this stage, many clients end up stuck — they’ve reached an agreement but can’t move it forward legally. CW5 exists to stop that happening.

What is OCDR?

It’s a non-court resolution (Out of Court Dispute Resolution), and covers all possible ways of resolving difficulties instead of court proceedings. It includes mediation, Resolution Together, collaborative law, arbitration and neutral evaluation for example. Any OCDR solution may be used alongside others in combination or individually. They are not one-time approaches and can be used and revisited whenever required. For example mediation and arbitration can be used in combination.

The research has long shown that decisions made together are more likely to last. This course provides a comprehensive guide to what is currently on offer and how each solution can complement others.

I’m junior and starting out, is the OCDR course relevant to me?

Absolutely – as a junior solicitor or legal executive you need to be aware of all possible ways available to your clients to help them find a lasting outcome.

The future for family law is a more holistic integrative approach, with an interdisciplinary team working together. This course provides a great starting point in fully understanding what is available, how to use each option and how to develop your practice.

I’ve been in family law for many years, is this relevant to me?

Yes! You may have trained as a mediator, or collaborative family practice, or even arbitration, or perhaps you’ve been involved in traditional solicitor-led negotiations, this course will bring all of these strands together, enabling you to tailor your offerings to the needs of your clients.
