Many couples assume that living together gives them the same legal protections as being married. In reality, that’s not the case.

One of the most important factors is how your home is legally owned.

Already have a will? You may need to hear this...

You should review your will whenever your circumstances change, including:

1️⃣ getting married or entering a civil partnership
2️⃣ separating or divorcing
3️⃣ having a child
4️⃣ buying or selling a property
5️⃣ receiving an inheritance or significant gift

Keeping your will current and aligned with your wishes helps avoid costly disputes down the line.

“We've lived together for years, so I have the same rights as a married couple.” It's one of the most common myths in family law, and it's wrong.

No matter how long you have lived together, you do not acquire the same rights as a married couple, in England and Wales.

That means property, savings and pensions are not automatically shared, and there is no right to claim spousal maintenance if you separate. Cohabitation is the fastest-growing family type in the UK, yet the law hasn't kept pace.

Still think you need to prove adultery, blame your spouse, or wait two years to divorce? The law has changed.

Since 6 April 2022, England and Wales has had “no-fault” divorce. You no longer need to prove adultery or unreasonable behaviour, or wait two years after separating. It is now enough to make a simple statement that your relationship has irretrievably broken down.

To apply, you need to have been married or in a civil partnership for at least a year, be domiciled or habitually resident in the UK, and confirm the relationship has broken down.

The change was designed to reduce conflict and let couples move forward with less confrontation. If you’re weighing up your options, our family law team can explain the process further in plain English.

“How long will it take?” is the question every buyer and seller asks first. Here's an honest answer.

A straightforward transaction may take between 8 and 12 weeks, though timing depends on factors like chains, mortgage offers and searches.

One key milestone to understand is exchange of contracts. Before exchange, either side can withdraw without penalty. After exchange, the transaction is legally binding and penalties may apply. On completion day, funds are transferred and you get the keys.

A divorce isn’t finished the moment the marriage legally ends. Here’s a step many people get wrong.

The minimum legal timetable is around 26 weeks: a 20-week reflection period before the Conditional Order, then a further six-week cooling-off period before the Final Order.

But the Final Order only ends the marriage. It does not resolve financial rights and responsibilities. Applying for it before your finances are settled can leave claims open and affect pensions, tax and even gifts in your will.

Our advice: in most cases, wait until finances are resolved before applying for the Final Order. Speak to our family team for guidance tailored to your situation.

What happens if you die without a will?

The law decides who inherits your estate, and the outcome may not be what you would expect...

Without a valid will, your estate is distributed according to the rules of intestacy. These rules follow a fixed legal framework and may not reflect your wishes, particularly if you have a blended family, are in a second marriage, live with an unmarried partner, or have children from a previous relationship.

A carefully prepared will gives you greater control over what happens to your assets. It can also help manage potential tax implications and reduce the risk of uncertainty or disputes for those you leave behind.
