Whether probate is required will depend on what the person owned and how those assets were held.

Probate is generally more likely to be required where the estate includes property or significant assets held in the deceased person’s sole name.

Jointly owned assets can be different. For example, property owned as joint tenants will usually pass automatically to the surviving owner, while jointly held bank accounts can often be transferred on production of a death certificate.

Every estate is different, so it’s important to confirm what's required before starting the process.

An LPA and a Deputyship Order can both allow someone to make decisions for another person, but they apply at very different stages.

An LPA is arranged while you still have mental capacity, allowing you to choose who you trust to act for you.

Deputyship may become necessary when someone has already lost capacity and doesn't have an appropriate LPA in place. This involves applying to the Court of Protection.
