Life Interest Trusts: Protecting Your Home and Family

Applying to the court yourself can feel overwhelming, especially where children are involved. One client came to us for help with a private special guardianship order (SGO), an order that gives someone parental responsibility for a child, and told us:

“Common law marriage” doesn’t exist.

Here’s what that means if you split up.

Many couples believe that living together for long enough gives them the same legal rights as a married couple. In England and Wales, it does not. There is no such thing as “common law marriage.”

If you separate, a cohabiting partner has no automatic right to a share of the other’s property or pension, or to maintenance for themselves, no matter how many years you have been together.

The reassuring part is that there are steps you can take, such as a cohabitation agreement or a declaration of trust, to protect you both. Speak to our family law team to find out where you stand.

Employment Tribunal Time Limits: The 2026 Rules Explained

The rules have changed. For events on or after 1 October 2026, most employment tribunal claims must now be started within six months less one day, double the previous three-month limit, following the Employment Rights Act 2025.

For events before that date, the older three-month limit still applies.

Who would manage your affairs if you couldn't?

None of us likes to think about a day when we can no longer make our own decisions. Yet a stroke, a serious accident or the early onset of dementia can arrive without warning, at any age.

Here is the part that catches so many families out. Without a registered Lasting Power of Attorney in place, no one has an automatic legal right to manage your finances, not even your husband, wife or adult children. Instead, your loved ones would need to apply to the Court of Protection to be appointed as a deputy.

That process is costly, stressful and can take many months. During that time, bills can go unpaid and important decisions can stall, leaving your family in limbo at an already difficult moment. And it is too late to set up an LPA once mental capacity has been lost.

The good news is that putting a Lasting Power of Attorney in place is far simpler than most people expect. It lets you choose someone you trust to look after your finances, property or health if you ever cannot, all on your own terms.
