MTM Family Law

MTM Family Law We are a specialist firm of family lawyers based in Glasgow (but covering the whole of Scotland) We consider this is the best possible recommendation.

We believe that being a small, boutique family law firm helps us to help you. It means that whilst we know about other areas of the law, such as company law and employment law, our knowledge is about how these other areas interplay with our specialist field. We have a close and friendly business partnership built on mutual respect. Your case will be important to us and the attention we give it wil

l be personal, but with the back-up of a highly experienced team. The partner dealing with your case is likely to attend court personally if your case reaches that stage; if she cannot she will explain why and send another specialist colleague. Being a small firm operating in a niche field brings benefits to our clients. We can offer flexible payment terms in many cases and we don’t have corporate pressures and targets. We are also able to remain at the cutting edge of all family law approaches. There are now many alternatives to litigation in court in family law. We can offer them all including reference to mediation, collaboration and family law arbitration. We are all members of the Family Law Association Scotland and we are affiliated to The Right Kind of Divorce. Most of our clients come to us by personal referral, usually from a friend or relative who has used our services or by referral from another solicitor. We are happy to receive comments on our posts, and welcome active engagement on our FB page. However, please refrain from posting offensive comments. Any inappropriate comments will be removed. If of course you have a genuine concern regarding a particular issue, please send us a direct message, either through FB or by email to [email protected] and we will give this matter our attention.

Why not mediate you way to a calm festive season.

Are you or someone you know separated and dreading how to resolve the arrangements for your children over the festive season? Why not mediate you way to a calm festive season.

As experienced family lawyers we know that often parents feel that the only way to have arrangements for your children resolved is to ask the court to make a ruling. This may involve you having to attend court in the lead up to Christmas at a time when you would rather be able to know what the plans and arrangements for your children are now, without all the added stress, expense and having to attend court in the lead up to the schools finishing. Why not consider mediation as an option to explore how you and your former partner/spouse can plan and come to arrangements between you.

We have three accredited family law mediators who are members of Calm Scotland, Caroline Smith, Michaela Hinchin and Shona Templeton (https://www.calmscotland.co.uk/mediators/smith-caroline/), (https://www.calmscotland.co.uk/mediators/hinchin-michaela/) (https://www.calmscotland.co.uk/mediators/templeton-shona/).

Mediation is in private and the discussions and negotiations regarding the arrangements for your children are all without prejudice. It is an opportunity for you to create a bespoke arrangement for your family that suits you. For example, you may have some Christmas/ festive traditions you would like to share with your children that you remember from your own individual childhoods. Mediation can provide a safe space with sufficient time to work the plans through and reality check how they would work for the benefit of your children.

Would you prefer to have reached a mutually acceptable outcome before your children open the first window on their Advent Calendar? Would you prefer to know what activities the school have and how each of you can support your children to make these activities memorable for the right reasons? Would you prefer to know what the Christmas/Boxing Day plans are so your children know how Santa is delivering the presents and your travel and family arrangements?

Children grow up so quickly and life can present many challenges for them. With some goodwill and an experienced mediator, you can give your children the best Christmas gift for this year and beyond by making these plans together as their parents. If you would like to know more then please give us a call at MTM Specialist Family Lawyers 0141 611 7535 or email Michaela at [email protected].

A controversial topic for a Tuesday morning! Did you support the Government's Gender Recognition Reform Bill? Could it have been made better? Should it have passed as currently drafted, or were the UK Government right to veto it? Answers on a postcard please!

The first casualty of the gender recognition regime is freedom of speech, writes barrister Naomi Cunningham. Section 29(2)(d) of the Scotland Act 1998 provides that an Act of the Scottish Parliament is not law so far is it is incompatible with any of the Convention rights. The UK government may not

We were back to business on 4th January after spending some well needed time off with friends and family over the holiday period. We are aware that not everyone will have been so lucky to have had a nice time, especially those in broken relationships who had many days to endure with their other half under the same roof. If we can help you with any family law advice then please do not hesitate to get in touch.

Last week we marked two special occasions at MTM Family Law. Firstly, we celebrated our 10th birthday. It’s been quite a journey! We now have six experienced and accredited solicitors working in our team, making us one of the biggest family law teams in Glasgow.
Sadly, we also saw the retirement of our conveyancing consultant, Gordon Cunningham. Gordon’s wise counsel and selection of pastel knitwear will be sorely missed! We all wish him the very best and hope he continues to be a regular visitor to our office 🥰

To mediate, or not to mediate, that is the question. And our answer is usually “yes”! Mediation is a voluntary process in which one of our trained family law mediators can help a couple reach their own solution to financial and child centred issues which may have arisen following separation. Shona Templeton, Caroline Smith and Michaela Hinchin were all lucky enough to be able to enjoy further valuable training with CALM last week. If you would like more information about CALM or the mediation process then please give us a call on 0141 611 7535.

Yey! Go us! We are delighted to have been included in Doyle’s Guide as the only “First Tier” Family Law Firm in the 2020 listing of Leading Glasgow Family and Divorce Law Firms. Congratulations also go to Caroline Smith (formerly Henderson) named as “Leading Glasgow Family and Divorce Lawyer”, and to Fiona Anderson who also comes highly “Recommended”. As you know, we don’t often blow our own trumpet but shall make an exception on this occasion!

To help reduce the spread of Covid19 the Scottish Government announced the closure of child contact centres at level 4 for both supervised and supported contact, excluding local authority centres which remain open. Child contact centres will be allowed to remain open at level 4 for handovers only. The guidance also encourages handovers to take place outdoors where possible, except where there are safety concerns for either parent or the child themselves. The guidance also encourages child contact centres to facilitate contact virtually where in person contact has had to stop. Full info can be found here. If this affects you and you need some guidance please contact our of our experienced family law solicitors.

The Scottish Courts and Tribunal Service have now advised court and tribunal users to wear face coverings when entering and leaving the building, while moving from one part of the building to another, or while waiting in communal areas such as reception points, witness rooms or outside a courtroom.
