If My Child Is Involved in an Accident, Can They Claim?

As a parent, seeing your child injured due to someone else's negligence is devastating. The good news is that children in Scotland are fully entitled to make a personal injury claim.

Because a child cannot legally raise a claim themselves, a parent or guardian acts on their behalf throughout the process. Any compensation awarded is protected and held in trust until the child reaches adulthood.

It is also worth knowing that in Scotland, if a claim is not made during childhood, your child has until their 21st birthday to raise one themselves.

Not Sure How Personal Injury Law Works?

If you have been injured due to someone else's negligence, whether that's a careless driver, an employer who failed to keep you safe or anyone else who had a duty of care towards you, you may be entitled to make a claim under Scots law.

And even if you were partly at fault, that doesn't mean you have no case. Your compensation is simply reduced to reflect your share of responsibility.

A successful claim can cover your medical expenses, lost income, pain and suffering and property damage depending on the nature of your injury.

Not sure where you stand? That's exactly what we're here for.

Partly at Fault? You Can Still Claim.

Many people walk away from accidents assuming that because they were partly to blame, they have no case. That simply isn't true.

Under Scots law, shared blame does not prevent you from making a personal injury claim. Your compensation is simply reduced in proportion to your share of responsibility, meaning you could still be entitled to a significant award even if the accident was partly your fault.

We recently secured a 60/40 liability split in favour of a client who was told they had no case at all. Don't write yourself off before speaking to someone who knows the law.

Get in touch with our team today for a free, no obligation consultation and find out exactly what you are entitled to.

Why Should I Speak to a Personal Injury Solicitor?

A question we hear often. So here's the honest answer.

Insurance companies have entire legal teams working to minimise what they pay out. Speaking to a personal injury solicitor ensures you have the same level of expertise fighting on your side.

A solicitor will assess your case, gather evidence, negotiate on your behalf and make sure you receive the full compensation you are entitled to under Scots law. Without one, you risk settling for far less than you deserve.

Still unsure? Get in touch with our team today for a free, no obligation consultation. It costs you nothing to find out where you stand.

When you seek medical treatment, you place your trust in the hands of professionals who have a duty under Scots law to provide you with a reasonable standard of care. When that standard falls short and you are left worse off as a result, that is clinical negligence and you are entitled to raise a claim.

Clinical negligence in Scotland can take many forms including misdiagnosis, surgical errors, delayed treatment, incorrect medication and poor aftercare. The consequences can be life changing and the impact on you and your family can be felt for years.

At Khan Law, we handle clinical negligence claims against NHS Scotland and private healthcare providers with the sensitivity and professionalism they deserve. We understand how daunting it can feel to raise a claim, and we are here to guide you through every step of the process under Scots law.

In Scotland you have three years from the date you became aware of the negligence to raise a claim. If you believe you have been let down by the standard of care you received, do not delay.

Get in touch with our team today for a free, no obligation consultation and find out exactly where you stand.

As a passenger, you are almost never at fault in a road traffic accident. Yet so many people walk away from these situations without ever making a claim simply because they didn't know they were entitled to.

Whether you were in a taxi, a friend's car, a bus or a private vehicle, if you were injured as a passenger through no fault of your own, you may be entitled to compensation.

Many passengers feel uncomfortable making a claim against someone they know. But it is important to understand that any claim is made against the driver's insurance, not against them personally.

If you have been injured as a passenger and aren't sure where you stand, get in touch with our team today for a free, no obligation consultation.

A Wet Floor Is Not Your Fault.

You slip in a supermarket. The floor was wet but there was no sign. Who is liable?

Under Scots law, businesses have a legal duty to keep their premises safe. No warning sign means they have breached that duty, and that makes them liable for your injury.

If this has happened to you, don't brush it off. Get in touch with our team today for a free, no obligation consultation and find out exactly what you are entitled to.

Congratulations to our solicitor, Ayesha Chaudhry, who successfully defended a motion to disapply QOCS protection at Glasgow Sheriff Court.

Counsel, instructed on behalf of the Defenders, argued that the pursuer's agents had acted manifestly unreasonably in their conduct of the case. We argued that our conduct was reasonable.

The court refused the Defender’s motion, upheld QOCS protection and granted expenses of the hearing in favour of the pursuer.

A great result and a testament to the strength of the defence presented. Well done Ayesha!
