Our client owned a residential property set within approximately 15 acres of land, subject to an existing mortgage. They were exploring the option of a lifetime mortgage to release equity while retaining ownership of their home.

🚧 The Challenge

This case presented a number of issues:

● The property was already subject to an existing mortgage.

● The lifetime mortgage lender only wanted to place a charge on the house and a small area of land less than 1 acre.

● As some firms restrict their services to properties with smaller acreages, many solicitors were unable to act due to the size of the land.

✅ The Outcome

Drawing on our decades of specialist experience in resolving complex cases, our team facilitated the successful partitioning of the land.

Following the registration of updated title deeds the client was able to secure a lifetime mortgage against the residential property and garden land only. The remaining land was excluded allowing flexibility for our client.

💡 Top Legal Tip

Ensure that clients have a properly drawn up plan of the land to be separated as this will help avoid any delays or complications with lenders and the bank.
