Separated but never married...what rights do you have to the family home?

In this video, Fiona explains how the law works in Scotland if you separate from a partner you were living with but weren’t married to.

Your rights can depend on factors such as whose name is on the property and whether you jointly own the home. In some situations, it may be possible to apply for occupancy rights or make a financial claim against your former partner.

Importantly, any claim must usually be made within one year of separation, otherwise you may lose the right to claim.

Buying, selling or remortgaging a flat in Scotland? You may have come across the term EWS1 👇

An EWS1 form checks the fire safety of a building’s external walls, including cladding and insulation and is often required by lenders before approving a mortgage.

Without it, your sale or remortgage could be delayed… or not go ahead at all.

While it’s an important safety step, the process can sometimes mean delays and added costs so it’s worth understanding early on.
