What happens when you come to the UK on a work visa, trust your employer to provide the job you were promised, and then find yourself struggling to make ends meet because you’re not given enough hours or paid what you’re owed?
In Patel v Metropolitan Care Services Ltd (Case No. 6005049/2025), a worker from India on a Skilled Worker visa took his employer to an employment tribunal after being denied his promised working hours and dismissed without notice.
The tribunal upheld his claims for unpaid wages, holiday pay, wrongful dismissal and failure to provide written employment particulars, awarding him ÂŁ28,123.
We get asked quite often if a non British citizen can access the UK's employment tribunal system and this real case shows the answer.
You do not have to be a British citizen to enforce your employment rights in the UK. Of course, we've seen time and time again that a visa sponsorship can create fear and a real power imbalance, but it does not automatically take away your right to seek justice.
For employers, this case is a reminder that promises made to sponsored workers matter, contracts must be handled properly, and employment obligations should never be overlooked.
For migrant workers, please know that your nationality does not automatically prevent you from bringing an employment tribunal claim.
