A recent newspaper article in The Times caught my attention.
A family whose parents had placed their home and investments into trusts to reduce inheritance tax and protect assets from care fees later found themselves facing around £40,000 in unexpected tax and legal costs.
Unfortunately, I regularly meet clients who have been told that putting their house into trust is the answer to care fees.
The reality is usually far more complicated.
A trust can be a valuable planning tool when used appropriately, but no arrangement should be entered into on the basis of marketing claims alone.
Independent legal advice at the outset is almost always cheaper than trying to undo a problem later.
