With the summer holidays just around the corner, you may be feeling uncertain about how to move forward if you have recently made the decision to separate or divorce.

Our advice is to remain calm and plan ahead where possible. Try to approach conversations with a clear focus, discussing important matters such as childcare arrangements and holiday plans. Whilst emotions can understandably run high, keeping communication constructive can help make the process easier for everyone involved.

It may also be beneficial to pause the legal formalities of a divorce until after the summer period. Taking time to rest, recharge, and be present with your loved ones can help you feel better prepared to face the next steps with clarity and confidence.

We are here to support you through every stage of the process. Whatever questions or concerns you may have, our team is here to help.

TOP TIPS if you’re considering moving in with your partner 🏡

Many people assume that moving in together automatically gives them rights over a property, but this is not always the case. Cohabiting does not provide the same legal protection as marriage or a civil partnership.

We often advise clients to consider a cohabitation agreement to clearly set out important arrangements, including who is contributing financially and whether either party has a legal interest in the property.

If you are considering cohabitating with your partner, call us today on 01788 555042 or email [email protected] ☎️

Pensions and Divorce ❗️

Often clients make the mistake of overlooking pensions when discussing the division of marital assets upon divorce. We always advise clients of the importance of pensions and it is likely that the pension assets can equal or exceed the value of the family home!

We advise clients to have a pension report to ensure that the value is being shared equally and fairly based on a number of factors.

A question we are frequently asked is: what options are available if a parent stops paying child maintenance?

The Child Maintenance Service (CMS) is an online system that calculates how much maintenance should be paid, based on factors such as where the child lives and the number of overnight stays with each parent.

Parents can choose to reach an agreement independently using the online calculator. However, if there is concern that payments may not be made, it is advisable to apply through the Child Maintenance Service. This allows them to monitor payments and take enforcement action if any are missed or delayed, provided they are notified.

Thinking about moving in with your partner? What an exciting new chapter!

If marriage is not currently part of your plans, it may be worth considering a Living Together Agreement (also known as a Cohabitation Agreement).

This type of agreement outlines how assets and finances will be managed in the event of separation or death.

It is important to note that cohabiting partners do not have the same automatic legal rights as married couples. The agreement can be tailored to suit your individual circumstances and reflect whatever arrangements are agreed.

There is a common misconception surrounding child contact disputes.

Many clients mistakenly believe that the court will automatically favour the mother in any child arrangements dispute. This is simply not the case and does not accurately reflect how the court process works.

The court’s primary concern is always the best interests of the child. It will generally seek to promote contact with both parents, unless there is a risk of harm to the child.

Disputes involving child arrangements are rarely straightforward, but with the right legal advice, you can feel confident about what to expect at any upcoming hearing.
