Father's Day this Sunday is a good moment to think about something most people keep putting off.

If you have a family depending on you, a Will isn’t a morbid thing to think about - it’s one of the most practical things you can do for them. It means that if something happens to you, the people you love are not left dealing with uncertainty on top of grief.

Without a Will, the law decides how your estate is divided, and that may not match what you would have wanted. It can also take much longer to sort out, cost more, and cause real tension between the people left behind.

A Will lets you say who gets what, who looks after your children if they are still young, and who you trust to carry out your wishes. It can also help reduce the inheritance tax your family might otherwise face.

If you already have a Will, it’s worth checking when you last updated it. Marriage, divorce, a new child, a property purchase - any of these can affect whether your Will still does what you think it does.

Property transactions rarely fail because of the big stuff - most delays come down to things that could have been sorted out weeks earlier.

Missing paperwork is one of the most common. Things like building regulations certificates, planning permissions, or guarantees for previous work on the property. If the seller cannot find them, everything slows down while copies are tracked down or indemnity insurance is arranged.

Slow ID checks. Anti-money laundering checks are a legal requirement and they have to be done before anything else moves forward. If buyers or sellers are slow to provide documents, the whole chain waits.
Slow mortgage offers. A lender taking longer than expected to process an application, or coming back with conditions that need extra information, can push completion back by weeks.

Leasehold issues. If the property is leasehold, the solicitor needs to get a management pack from the freeholder or managing agent. Some take a very long time to respond, and there is not much anyone can do to speed them up.

Problems found in searches. Local authority searches, drainage searches, and environmental searches can all flag issues that need looking into before the buyer is happy to proceed.

A slow link in the chain. Even if your side is ready to go, one slow party further up or down the chain affects everyone.

The best thing you can do is get your documents together early, respond to requests quickly, and instruct a solicitor as soon as your offer is accepted - not after.

Buying a property throws up a lot of questions, especially if it is your first time. Here are some of the things we get asked most often 🏡

🗓️ How long does conveyancing take? Usually between 8 and 12 weeks, but it depends on the chain, the searches, and how quickly everyone responds. Leasehold properties and new builds can take longer.

🔎 Do I need a survey? Your mortgage lender will carry out a valuation, but that’s not the same as a survey. A survey looks at the condition of the property, and it can flag issues before you are committed, and it could save you money in negotiations.

? What is the difference between exchange and completion? Exchange is when the contracts are signed and the deal becomes legally binding. Completion is when the money moves and you get the keys. There is usually a gap of one to four weeks between the two.

❌ Can I pull out before exchange? Yes, and so can the seller. Until contracts are exchanged, nothing is legally binding, and that’s why getting to exchange as quickly as possible matters.

🧑‍💼 What does a solicitor actually do? A lot - title checks, searches, reviewing contracts, raising enquiries, dealing with the mortgage lender, handling the transfer of funds, and registering you as the new owner with the Land Registry.

📝 What do I need to have ready? Proof of identity, proof of address, and proof of where your deposit is coming from. Anti-money laundering checks are a legal requirement, so the sooner you have these ready, the faster things move.

This week is Carer's Week, and it’s a good moment to think about something most people put off for too long.

If you’re caring for someone, or someone cares for you, the right legal documents can make an enormous difference to what happens when things get harder.

A Will means your wishes are followed, as without one, the law decides who gets what, and it may not match what you would have wanted.

A Lasting Power of Attorney lets someone you trust manage your finances or make health decisions on your behalf if you lose the ability to do so. Without one, your family may face a long and costly court process just to help you.

Buying a second property? You will likely pay more in stamp duty than you did the first time around.

From April 2025, anyone buying an additional residential property in England and Northern Ireland pays a 5% surcharge on top of the standard stamp duty rates.

That applies to buy-to-let purchases, holiday homes, and second home, even if you’re just helping a family member onto the ladder as a co-buyer.

The surcharge kicks in on the full purchase price, not just the part above a threshold. So on a £300,000 second home, you are not just paying a little more - you could be looking at a stamp duty bill roughly double what a first-time buyer would pay on the same property.

There are some exceptions. If you are replacing your main home and sell the old one on the same day, the surcharge usually does not apply. But the rules around timing, ownership history, and overseas property are complicated, and getting it wrong is an expensive mistake.
