Receiving the Grant of Probate is an important milestone, but it does not necessarily mean the estate should immediately be distributed.

Executors may still need to collect assets, settle outstanding liabilities, deal with tax matters and make sure other aspects of the estate administration have been completed.

Distributing an estate too early can create difficulties if an unexpected liability or claim later arises.

A person's debts do not automatically disappear when they die.

As part of administering an estate, the executor or administrator will need to establish what liabilities are outstanding and arrange for valid debts to be paid from the estate before the remaining assets are distributed to beneficiaries.

This is one reason executors should be careful about distributing an estate too quickly.

Being an executor carries important responsibilities.

Executors are responsible for administering the estate correctly, which can include valuing assets, dealing with debts and tax, collecting assets and eventually distributing the estate to the beneficiaries.

Mistakes can sometimes have financial consequences for an executor personally, particularly if assets are distributed incorrectly or important liabilities or claims are overlooked.

You remain responsible for your role as executor, but you can instruct a solicitor to help with some or all of the administration.

Choosing your executor is an important part of making a Will.

Your executor will be responsible for dealing with your estate after your death. This may include valuing your assets, settling liabilities, dealing with Probate and distributing your estate according to your Will.

Think carefully about choosing someone who is trustworthy, organised and comfortable taking on the responsibility.
You can appoint more than one executor, and it is sensible to speak to the people you have in mind before making your decision.

Trusts are sometimes associated with substantial wealth, but they can be useful in many different family circumstances.
For example, a Trust may be considered where someone wants assets to be managed for a young beneficiary or a person who is vulnerable.

A Trust can be created during someone's lifetime or through a Will, and different types of Trust have different legal and tax consequences.

They aren't appropriate in every situation, which is why individual advice is important.
