Who can act as a certificate provider for a Lasting Power of Attorney?

It's an important role, but one that is often misunderstood.

A certificate provider helps protect the person making the Lasting Power of Attorney by confirming they understand the document and are making it of their own free will. There are rules about who can act in this role, and not everyone is eligible.

In this video, I explain what a certificate provider does and who can act as one, so you can avoid unnecessary problems when completing your Lasting Power of Attorney.

TRUE! Your Will should be reviewed when your circumstances change.

Life rarely stays the same. Marriage, divorce, the arrival of children or grandchildren, changes to your finances, or the death of someone named in your Will can all be good reasons to review the arrangements you have in place.

Even if you don't need to make any changes, reviewing your Will periodically can give you reassurance that it still reflects your wishes and current circumstances.

If you're looking for a Will-writing solicitor in Colchester and would like help reviewing an existing Will or making a new one, Iโ€™d be happy to talk you through your options.

Can an executor be paid for administering an estate?

The answer often surprises people.

In most cases, family members and friends acting as executors are not paid for their time. However, there are exceptions, and executors can usually reclaim certain expenses.

If you've been appointed as an executor, or you're choosing one for your own Will, it's important to understand the rules.

If you have any questions about administering an estate or need advice from an experienced probate solicitor, please get in touch.

โœ… TRUE!

Although couples often make their Wills at the same time, each person needs their own individual Will.

Your Will sets out your personal wishes, including who should inherit your estate, who you would like to act as your executors, and, if applicable, who you would like to appoint as guardians for your children.

Even if you and your spouse or partner have identical wishes today, having separate Wills ensures each of your intentions is clearly documented and legally valid.

If it's been a while since you made your Will, or you've never made one at all, it's worth taking the time to review your arrangements.

๐Ÿ“ž If you'd like advice on making or updating your Will, I'd be happy to help.

If you were suddenly taken into hospital, who would pay your bills?

Many people assume their husband, wife or adult children could simply step in. Unfortunately, that's not always the case.

Without a Lasting Power of Attorney, your loved ones may not have the legal authority to manage your finances or pay your household bills on your behalf.

A Lasting Power of Attorney allows you to choose someone you trust to make financial decisions for you if you're no longer able to do so yourself.

As one of the lasting power of attorney solicitors in Essex, I help clients put these important documents in place before they're needed, giving them and their families valuable peace of mind.

Have you thought about who you would choose?

Have you ever checked whose name your household utility bills are in?

It's one of those small admin jobs that most people never think about, but it can make a big difference when someone dies.

If the gas, electricity, water, or broadband accounts are all in one person's sole name, the surviving partner may find they have to close accounts, open new ones, and update payment details at a time when they're already dealing with so much.

The good news? It usually only takes a few minutes to check, and if you decide to change the accounts into joint names, most utility companies make the process straightforward.

As a probate solicitor, I often help families navigate the practical issues that arise after a bereavement, and this is one small step that can make life much easier.

๐ŸŽฅ In my latest video, I explain why this small check is so important and what you should do.

Whether it's making a Will, putting Lasting Powers of Attorney in place, or planning your estate, taking action today can make things much easier for the people you care about tomorrow.

Having the right legal plans in place isn't just about protecting your assets; it's about giving yourself and your loved ones peace of mind.

If you're ready to start the conversation, I'm here to help. Feel free to drop me a message.
