Is genericide to blame for the trouble at Tupperware? Recent reports suggest that Tupperware could be on the verge of going out of business soon without investment. Once the innovative, market-leader in plastic food storage containers, Tupperware has now become a generic term for sealable plastic food containers - with many consumers not even aware that Tupperware is a brand.

The term genericide refers to the way in which careless and incorrect use of a trade mark can lead to it becoming a generic term for the product that it describes.

This causes it to lose distinctiveness and therefore no longer be registerable. eg HOOVER, ASPIRIN, ESCALATOR, KLEENEX, BAND-AID, YO-YO, THERMOS and WINDSURFER

To avoid genericide always use your trade mark as an adjective rather than a noun or verb.

E.g. HOOVER vacuum cleaner, LEGO toy blocks or OREO cookies
