There’s a simple gifting allowance that can help reduce the value of your estate for inheritance tax purposes.

Each tax year, you can give away up to £3,000 using your annual exemption, with no seven-year rule applying to that exempt amount. For couples, each person has their own individual allowance. There are also separate exemptions for certain smaller gifts, including gifts of up to £250 per person in qualifying circumstances.

Gifting from surplus income can be a powerful way to pass money on while you’re still alive. If your regular income comfortably covers your normal standard of living, the genuine surplus may be gifted away and potentially fall immediately outside your estate for inheritance tax purposes.

Unlike many other gifts, there’s no seven year waiting period and there’s no fixed upper limit. The key is being able to show the gifts came from surplus income, formed part of a regular pattern and didn’t affect your usual standard of living.

Without a Lasting Power of Attorney, your family can’t access your bank accounts, make decisions about your care, or manage your affairs, even if they desperately need to. They’d have to apply to court instead. It’s costly, slow, and avoidable.

There are two types of LPA: one covering your Property and Financial Affairs, one covering your Health and Welfare. Both can only be set up while you still have mental capacity.
