Hugh qualified in 1989 before joining Jolliffes in 1996 and becoming a partner in 2000. Are you using AI to enhance your work? If so, do you know who owns the rights your final products?

You might think that, if you produce content using AI, you own the rights in the final materials that you produce; however, that may not always be the case.

Due to the fast paced, recent development of AI tools, the law has not yet been able to catch up and lawyers are having to apply existing rules of laws to new technologies and situations to determine the most likely outcome (that is, until the issues reach the Courts and they set new precedents based on Court decisions; or the Government brings in legislation to deal with the same).

If a human plays a key role in the creative process, they may still hold the copyright; however, AI-generated content doesn't always have clear copyright protection. In some regions, only entirely human-created works can be copyrighted, leaving AI-generated works in legal limbo. If generative AI creates something independently, without much human intervention, ownership can become even more uncertain.

🏠 Deposits are something else that we often get asked about by potential house buyers.

When a conveyancer talks about the deposit, they are usually referring to the deposit payable under the sale contract on exchange. The deposit will usually be 10% of the purchase price.

This is different from your mortgage deposit, which is the amount by which you have to ‘top up’ the mortgage advance to make up the full purchase price. Where you exchange contracts for less than 10% deposit, you are still usually liable to pay a 10% deposit in the event you pull out after exchange of contracts and the other party sues for breach.

Exchange and completion. 🏠

You will hear these terms used a lot as you go through the process of buying or selling a house, but what is the difference?

Exchange of contracts: This is when the agreement for you to buy or sell a property becomes legally binding. The purchase price cannot be changed, the parties are tied in, and the date for completion is set. Before exchange, either party may pull out of the transaction or change the terms (such as the price), typically without incurring any cost to the other. Exchange therefore often happens before the date of completion (sometimes weeks in advance) so that the parties are ‘locked in’. Once exchanged, you have peace of mind and can book in things such as removal vans without wondering if the date

Completion: This is the final step in the process, when funds are paid to the seller. On completion, the buyer becomes the legal owner of the property and the keys are handed over!

Whether you’re a business looking for a wider reach or a trendy individual looking to make their mark online as an influencer, having a basic understanding of intellectual property law is crucial to ensuring you don’t end up on the receiving end of an expensive claim for infringing on someone else’s intellectual property rights.

In the UK, a creator will own the copyright in their works as soon as they have created them - they do not need to register these rights anywhere - and those rights will last for at least 70 years after the copyright holder dies.

Music is a particularly tricky type of copyright as it actually comprises several distinct works: the musical score, the lyrics (if any), the musical arrangement, and the recording itself (i.e. the thing you actually hear).

Unauthorised use of works (even a few seconds of a clip) may be be an infringement on someone's copyrights. The owner would therefore have the right to sue you for their losses and require you to handover any profits you make from the unauthorised use of those works. They can also ask you to delete your works and to hand over any copies of them.

So, what happens where you make a video with a popular song as the background music? Will you have infringed on Chappell Roan’s rights if you make a TikTok video dancing to Pink Pony Club? Will Journey sue you for having Don’t Stop Believing as the background to your inspiration video on LinkedIn or instagram? Well, it depends on the app/platform that you use and how the audio is added.

If a song is available in TikTok's library, you can use it in your videos on that app as there will be a copyright licence agreement in place; however, you can't use tracks on other platforms. Also, this only applies to music from TikTok’s Commercial Music Library. If you just put the music on the radio playing in the background of your video, that won’t cut it.

What are the risks of going to court without legal representation?

1. Complex legal procedures

Court rules (such as the Civil Procedure Rules in England & Wales) are strict. Filing the wrong paperwork or missing deadlines can weaken your case or result in it being thrown out of Court completely. It can also mean having to pay all or sum of the other party’s legal costs.

2. Lack of legal strategy

Litigation isn’t just about stating your case; it requires a strong legal argument based on legal precedents. A solicitor will be able to apply the correct legal principles (including reference to case law that helps your case), anticipate counterarguments and overall strengthen your position.

3. Higher financial risk

Without expert legal advice, there is a risk that you may settle your dispute for less that you are entitled to and you may lose more than expected. There is also the risk that, if you lose (for example, because you did not have a strong legal argument, crafted by an expert solicitor), you may have to pay the other party’s costs.

4. Negotiation disadvantages

Solicitors know how to leverage legal arguments to secure a better deal in settlements or mediation. Individuals who represent themselves may struggle to negotiate against seasoned legal teams, who can make a strong argument in their client’s favour.
