We were proud to support Macmillan Cancer Support by hosting a Coffee Morning Fundraiser at Festival Law, where we specialise in helping those affected by asbestos-related diseases. We know that lots of our clients and their families have been supported by Macmillan nurses and we are pleased to support and raise the profile of this valuable resource.

When will companies learn?.....

The HSE have confirmed that another construction company have been fined after exposing workers to asbestos whilst removing asbestos insulation boards from a public house, and failing to carry out a full asbestos survey beforehand. At Festival Law, we are all too familiar with the risks of exposure to the potential deadly asbestos dust and the devastating effect that this can have on a person and their family when someone contracts an asbestos related disease.

Regulations have been in place for years and therefore there is no excuse for exposing any employees to asbestos dust without the correct advice and protective equipment being provided.

This month Festival Law highlights one of their own, Peter Lodge, who celebrates being in the legal world for 40 years.

Peter commenced his employment with Elgood’s solicitors on the 1st August 1985 and when the company merged with Bretherton Price in the early 1990’s, he played a major part with one of the partners, Mark Ovington in expanding the Personal Injury Department, and in particular, the disease section. He was instrumental in giving talks to both current and retired workers from the old Rover plant in Oxford, which subsequently resulted in the team pursuing some 12,000 deafness claims. Peter remained with BPE until February 2012 when the firm ceased doing personal injury work.

He joined Festival Law in October 2012 not long after the firm was formed, and following a short stint with Slater & Gordon in Birmingham, he continues to play a leading role in work acquisition, and disease related claims.

“My interview for Elgoods was with one of the Partners, Richard Handley, and at the Old Pats rugby club, which clearly wouldn’t happen these days at all. I think he only offered me a job was because I played rugby and could drink a bit too”.

Peter also commented “ The personal injury world has changed hugely since I first started 40 years ago, and sadly many personal injury firms are no longer trading because of those changes. I have always been of the view that if you do a good job for a client, they will refer other clients to you, and this has proved to be the case. We are fortunate that Festival Law has a very good reputation locally, and many other law firms locally know us and recommend clients to us”.

M O D Asbestos Deaths

An interesting article on the front page of the Daily Mail (4/8/25) highlights the ongoing threat of the “hidden killer” that is asbestos, and more importantly, the significant numbers of mesothelioma deaths for both service men and women. Quite alarmingly, the article comments that exposure to asbestos through various sources caused more deaths than those lost in the Afghanistan campaign. Liz Darlastan, who is the Chief Executive of the charity Mesothelioma Uk commented, “We should hang our heads in shame - exposing our boys and girls to asbestos is killing them way faster than the Taliban ever could”.

Exposure to the deadly material in poor military accommodation, ships, submarines, helicopters and even tanks is causing an average of 89 cases a year of mesothelioma - a fatal cancer.

Taking short cuts to remove asbestos……is it really worth the risk?

The HSE continue to prosecute offenders who fail to adhere to regulations surrounding the removal of asbestos. In a recent case, a builder was sentenced to a 12-month Community Order for removing asbestos without a licence from a house that was being renovated. It is still hard to believe that some people working with asbestos are either oblivious, or unconcerned, to the risks of being exposed to potentially fatal asbestos dust. Exposure to asbestos can be a danger not only to those working directly with asbestos but also to those in the same vicinity.

At Festival Law, we regularly see the tragic consequences for someone who has been diagnosed with a terminal lung condition, along with the effect that such a condition has upon families and loved ones. It is never worth taking short cuts to remove asbestos without taking full precautions.

HSE : Global Asbestos Awareness week……..

Even now, some 25 years on from when asbestos was banned in the UK, the “silent killer”, asbestos, is still responsible for approximately 5,000 deaths a year in Great Britain. The HSE quite rightly want to highlight the risks surrounding the use of asbestos, and the exposure to disturbed asbestos fibres. As part of the Asbestos and You campaign the HSE provides invaluable advice about the risks surrounding asbestos exposure, particularly for those working in trades where such exposure is more likely.
