Many people believe that putting their children’s names on the title deeds of their home will protect the property from care fees or inheritance tax (IHT) but unfortunately, it’s not that simple.

If you continue living in the property after transferring ownership, it is classed as a “Gift with Reservation of Benefit.” This means that when you pass away, the property may still be treated as part of your estate for probate and inheritance tax purposes.

The same applies to care fees. Local authorities can treat the property as “notional capital,” meaning they can still include it in financial assessments and could force a sale to help pay for care costs.

Importantly, the so-called “7-year rule” does NOT apply in these situations.

Many couples put mirror wills in place believing their home is fully protected. Unfortunately, that’s not the case.

A mirror will does not protect your property from:

Being assessed for care fees
The surviving spouse remarrying
Your children potentially losing out in the future

“Marriage Revokes Wills – And Your Children Could Lose Out.”

If you’ve remarried and have children from a previous relationship, this is crucial.

Marriage automatically revokes your existing Will (unless it was made in contemplation of that marriage).

If you don’t put a new Will in place, you die intestate. Under intestacy rules, your spouse inherits.

But here’s the part many people don’t think about…

If your spouse later dies without making a Will, their estate will pass under intestacy rules to their children — not yours.

That means the assets you worked for, and may have wanted your own children to receive, could ultimately end up in someone else’s bloodline.

In blended families, hoping for the best is not a strategy.

Have you ever thought about Lasting Powers of Attorney?

Most people assume they’re only for later life — but honestly, they’re just about making life easier if something unexpected happens.

If you lose capacity and don’t have LPAs, your family can’t just help out.
They have to apply to the Court of Protection to deal with your affairs.

That means:
Months of waiting
can take a year to finalise
Thousands of pounds in costs
A lot of stress at a bad time

All of that is totally avoidable.

And here’s the bit many people don’t realise…
A Property & Financial Affairs LPA can be used even if you haven’t lost capacity.

So it’s really handy if:
You’re on holiday and need someone to sort things
Your local bank branch has closed
You want help dealing with pensions or paperwork
You just want someone you trust to step in when needed

Get them done once, forget about them — and know you’re covered.

Without an LPA, loved ones have no automatic rights
This surprises a lot of people
even:
Spouses or partners
Parents of adult children
They cannot legally:
Access bank accounts
