We recently asked Olivia whether court is the only option when resolving family matters.

In many cases, it is not. Court is often a last resort rather than a starting point. Many matters can be resolved through non-court dispute resolution, such as mediation, solicitor-led negotiations or arbitration. These approaches are typically more cost-effective, less confrontational and can allow for more flexible, amicable outcomes.

Court is usually reserved for situations where other options are not suitable.

Meet Courtenay ✨

Courtenay recently joined Lux Family Law as a qualified solicitor, advising on matters including divorce, finances, separation and children. There’s a common assumption that “if it’s in my name, it’s mine” but that’s not always the case.

In family law, the court looks at matrimonial assets. Even if something is held in one person’s name, if it has been built up or used during the marriage, it may still be considered as part of the overall financial settlement.

This can include property, savings or investments. What matters is not just whose name it is in, but how and when the asset was acquired.

Do grandparents have a legal right to see their grandchildren?

We asked Olivia, and the answer is not automatically. Grandparents do not have an inherent legal right to contact.

However, if contact is being prevented, grandparents can apply to the court for a child arrangements order. The key difference is that they must first seek the court’s permission before making the application.

Each case will depend on what is in the best interests of the child.
